RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
PERMANENT AND TEMPORARY EASEMENT CONTRACT TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND APPROVING
CERTAIN DEED AND EASEMENT.
WHEREAS, the City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described
parcels is necessary to carry out the construction of the storm
water drainage for the Cloverdale area as well as the Agremp
property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcels
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed
to pay for the properties and the incidental expenses necessary
to the consummation of the sales from City funds.
The subject parcels are:
Permanent Easement
That part of the Southwest Quarter ( SW 4 ) of Section Ten
( 10) , Township Eighty-nine North (T89N) , Range Thirteen West
(R13W) of the Fifth Principal Meridian, Waterloo, Black Hawk
County, Iowa, described as follows:
Beginning at a point on the East line of said Southwest
Quarter (SW 4 ) which is Ninety ( 90 . 0) feet South of the
North line of Midland Street as platted in Cloverdale Acres ,
Waterloo, Iowa;
Thence West at right angles with said East line a distance
Ninety-one and Seventy-one Hundredths ( 91 . 71) feet to a point
which is Twenty ( 20) feet normally distant, Northeasterly of
the Northeasterly right of way line of the Chicago Central
and Pacific Railroad;
Thence Northwesterly parallel with said Northeasterly line
One Thousand Two Hundred Ninety and Sixteen Hundredths
( 1290 . 16) feet to the Northwesterly line of that tract as
described in Land Deed 594 at Page 565, Black Hawk County
Recorder ' s Office;
Thence Southwesterly along said Northwesterly line to the
Northeasterly right of way line of said Railroad;
Thence Southeasterly One Thousand Four Hundred Thirty-three
and Thirty-three Hundredths ( 1433 . 33 ) feet along said
Northeasterly right of way line to the East line of said
Southwest Quarter ( SW 4 ) ;
Thence North One Hundred Nine ( 109 . 00) feet to the point of
beginning.

Temporary Easement
That part of the Southwest Quarter ( SW ) of Section Ten

(R13W) of the Fifth Principal Meridian, Waterloo, Black Hawk
County, Iowa, described as follows:
Commencing at a point on the East line of said Southwest
Quarter (SW 4) which is Ninety ( 90. 0) feet South of the
North line of Midland Street as platted in Cloverdale Acres,
Waterloo, Iowa;
Thence West at right angles with said East line a distance
of Fifty-four and Twenty-four Hundredths ( 54.24) feet to the
point of beginning;
Thence continuing West Thirty-seven and Forty-seven
Hundredths ( 37. 47) feet to a point which is Twenty ( 20) feet
normally distant, Northeasterly of the Northeasterly right
of way line of the Chicago Central and Pacific Railroad;
Thence Northwesterly parallel with said Northeasterly line
One Thousand Two Hundred Ninety and Sixteen Hundredths
(1290. 16) feet to the Northwesterly line of that tract as
described in Land Deed 594 at Page 565, Black Hawk County
Recorder's Office;
Thence Northeasterly along said Northwesterly line to a
point which is Forty-five ( 45. 0) feet Northeasterly and
normally distant from said Northeasterly Railroad right of
way line;
Thence Southeasterly One Thousand Three Hundred Fifteen and
Forty-one Hundredths ( 1315.41) feet to the point of
beginning, except that part of the above described property
which is presently occupied by the Agremp Corporation' s
asphalt scale approach driveway.
Area = 30 , 260 S.F. more or less, excluding asphalt drive.
