HomeMy WebLinkAbout1989-532-10.02.1989 RESOLUTION NO. 1989-532 RESOLUTION APPROVING WAIVER OF THE BUILDING MORATORIUM ON RELOCATED HIGHWAY 218 CORRIDOR FOR IOWA PUBLIC SERVICE, IN THE CITY OF WATERLOO, IOWA. WHEREAS, Iowa Public Service, has requested a waiver of the building moratorium on Relocated Highway 218 Corridor to construct electrical overhead transmission lines across Relocated U.S. 218 at Duryea Street, and; WHEREAS, a public hearing was held on October 2, 1989, at 7 :00 p.m. in the City Hall Council Chambers, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the request to approve the above mentioned request; legally described as follows: A strip of land 50 feet in width across a part of vacated Witry Street in Waterloo, and Lots 20, 21 and 22, Block 15, in Westfield, in Waterloo; and A strip of land 50 feet in width across that part of the SE* of the SE* of Section 22, Township 89 North, Range 13 West of the 5th P.M. , that lies East of and adjacent to Lots 12 , 13, 14 and 15, Block 29, in Westfield, in Waterloo; and A strip of land 50 feet in width across Lots 10 and 11 and that part of Lot 9 lying North of the Northerly right-of-way line of proposed Highway 218, Block 29, in Westfield, in Waterloo; and A strip of land 25 feet in width lying East of and adjacent to that certain tract of land owned by Dawson Foundry, Inc. , as recorded in the office of the Black Hawk County Recorder in Book 599, Pages 538-540, being located in Lots 6 and 7, Block 29, in Westfield, in Waterloo; vacated Duryea Street in Waterloo; Lots 10, 11 and 12, Block 21 in Westfield, in Waterloo; and Lots 16 and 17 , Block 22 in Vaughn Subdivision of Westfield, in Waterloo; and A strip of land 50 feet in width across vacated Duryea Street and Lots 9 and 10, Block 22 in Vaughn Subdivision of Westfield, in Waterloo, all in Black Hawk County, Iowa. WHEREAS, it is the opinion of this Council that said waiver of building moratorium on Relocated Highway 218 Corridor be approved, as requested. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the waiver to the building moratorium on Relocated Highway 218 Corridor, for Iowa Public Service, to construct electrical overhead transmission lines across Relocated U.S. 218 at Duryea Street, be and the same is hereby approved. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward a copy of this resolution to the Black Hawk County Recorder for recording in order that this said action may become a matter of official County Record.
