Time of Meeting: 7 : 00 o'clock P .M. Place of Meeting: Council Chambers, City Hall, Waterloo, Iowa PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date, time and place above set out. The tentative agenda for said meeting is as follows: - Public hearing on the proposed Rath Tax Increment Redevelopment Area Plan. - Resolution determining an area of the City to be a blighted area and an economic development area, and that the rehabilitation, conservation, redevelopment, development or a combination thereof, of such area is necessary in the interest of the public health, safety or welfare of the residents of the City; designating such area as appropriate for an urban renewal project; and adopting the Rath Tax Increment Redevelopment Area Plan therefor. Such additional matters are set forth on the addi- tional page(s) attached hereto. (number) This notice is given at the direction of the Mayor pursuant to Chapter 21, Code of Iowa, and the local rules of said governmental body. There were present Mayor Bernard L. ATTORNEYS AT LAW DES MOINES,IOWA This being the time and place fixed for a public hearing on the matter of the adoption of the proposed Rath Tax Increment Redevelopment Area Plan, the Mayor called for any oral objections to the adoption of the Plan. The City Clerk/Auditor reported that no written objections thereto had been filed. The Mayor stated that the proposed Plan had been approved by the Planning and Zoning Commission as being in conformity with the general plan for development of the City as a whole. Council Member Budak seconded the motion to adopt. ATTORNEYS AT LAW DES MOINES.IOWA • RESOLUTION NO. 1990-644 RESOLUTION DETERMINING AN AREA OF THE CITY TO BE A BLIGHTED AREA AND AN ECONOMIC DEVELOPMENT AREA, AND THAT THE REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY; DESIGNATING SUCH AREA AS' APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND ADOPTING THE RATH TAX INCREMENT REDEVELOPMENT AREA PLAN THEREFOR WHEREAS, this Council has reasonable cause to believe that the area described below satisfies the eligibility criteria for designation as an urban renewal area under Iowa law; and WHEREAS, a proposed Rath Tax Increment Redevelopment Area Plan for the area described below has been prepared, which proposed Plan is attached hereto as Exhibit A; and WHEREAS, this proposed Plan Area includes and consists of: Beginning at the point of intersection of the centerline of East Eleventh Street and the Northerly bank of the Cedar River, thence Northeasterly along the centerline of East Eleventh Street to its intersection with the centerline of Franklin Street, thence Southeasterly and Easterly along the centerline of Franklin Street to its intersection with the centerline of Vinton Street, thence Southerly along the centerline of Vinton Street to its intersection with the centerline of Sycamore Street, thence Southeasterly along the centerline of Sycamore Street to its intersection with the centerline of Dunham Place, thence Southerly along the centerline of Dunham Place and an extension of the centerline of Dunham Place to its intersection with the Cedar River, thence Northwesterly along the Northerly bank of the Cedar River to the point of beginning. WHEREAS, it is desirable that these areas be redeveloped as part of the overall redevelopment area covered by said proposed urban renewal plan to be known hereafter as the "Rath Tax Increment Redevelopment Area Plan" ; and WHEREAS, the Iowa statutes require the City Council to submit the proposed Rath Tax Increment Redevelopment Area Plan to the Planning and Zoning Commission for review and recommendation as to its conformity with the General Plan for development of the City as a whole, prior to City Council approval of such urban renewal project and an urban renewal plan therefor; and • WHEREAS, creation of the Rath Tax Increment Redevelopment Area Plan Area and adoption of the Rath Tax Increment -4- MILERS.Ct )NEY.Dt1RWEILER.H:11?IE.sMITH .1LLBEE.P.C. Redevelopment Area Plan therefor, attached hereto as Exhibit A, was approved by the Planning and Zoning Commission for the Cgeneral planOctober 8 , 1990, as being in conformity with the plan for development of the City as a whole, as amended, as evidenced by its written report attached hereto as Exhibit B and incorporated herein by this reference; and WHEREAS, by resolution adopted November 5 , 1990, this Council set a public hearing on the adoption of the proposed Rath Tax Increment Redevelopment ea ea'Plank forP its M. imen eting e goof November 19 , 1990 at - 0 ncil Chambers, City Hall, Waterloo, Iowa, and due and proper notice f said public hearing was given, as provided by law, by publication in the Waterloo Courier on November 9 , 1990, which notice set forth the time and place for this hearing and the nature and purpose thereof; and • WHEREAS, in accordance with said notice, all persons or organizations desiring to be heard on said proposed Plan, both for and against, have been given an opportunity to be heard with respect thereto and due consideration has been given to all comments and views expressed to this Council in connection therewith and said public hearing has been closed. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: 1. That the findings and conclusions set forth or contained in the proposed "Rath Tax Increment Redevelopment Area Plan" for the area of the City of Waterloo, Iowa legally described and depicted on Exhibit A hereto and incorporated herein by reference (which area shall hereinafter be known as the "Rath Tax Increment Redevelopment Plan Area") , be and the same are hereby adopted and approved as the findings of this Council for this area. 2. This Council further finds: a. A feasible method exists for the location of families who will be displaced from the Rath Tax Increment Redevelopment Plan Area into decent, safe and sanitary dwelling accommodations within their means and without undue hardship to such families; b. The Rath Tax Increment Redevelopment Area Plan conforms to the general plan of the City as a whole; and c. As to those areas of open land to be acquired by the City included within the Rath Tax Increment Redevelopment Plan Area: _5_ :1t1LEtiS.C(N I\EY,pOR10EtLER.tt.U1tE.N\iITH S.1LLBEE.P.f.. BGGK ���'J PAGE 88 . • (1) With reference to those portions thereof which are to be developed for residential uses, this City Council hereby determines that a shortage of housing of sound standards and design with decency, safety and sanitation exists within the City; that the need for housing accommodations has been or will be increased as a result of the clearance of slums and other areas, including other portions of the urban renewal area; that the conditions of blight in the area and the shortage of decent, safe and sanitary housing cause or contribute to an increase in and spread of disease and crime, and constitute a menace to the public health, safety, morals or welfare; and that the acquisition of the area for residential uses is an integral part of and essential to the program of the City. (2) With reference to those portions thereof which are to be developed for non-residential uses, such non-residential uses are necessary and appropriate to facilitate the proper growth and development of the City in accordance with sound planning standards and local community objectives. 3 . That the Rath Tax Increment Redevelopment Plan Area is a blighted and an economic development area within the meaning of Iowa Code Sections 403.17 (a) and 403.17 (20) , respectively; that such area is appropriate for commercial and industrial enterprises and is eligible for an urban renewal project and otherwise meets all requisites under the provisions of Chapter 403 of the Code of Iowa; and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, of such area is necessary in the interest of the public health, safety or welfare of the residents of this City. 4 . That the Rath Tax Increment Redevelopment Area Plan, • attached hereto as Exhibit A and incorporated herein by reference, be and the same is hereby approved and adopted as the "Rath Tax Increment Redevelopment Area Plan for the Rath Tax Increment Redevelopment Plan Area"; the Rath Tax Increment Redevelopment Area Plan for such area is hereby in all respects approved; and the City Clerk/Auditor is hereby directed to file a certified copy of said Rath Tax Increment Redevelopment Area Plan with the proceedings of this meeting. • 5. That the Rath Tax Increment Redevelopment Area Plan for the Rath Tax Increment Redevelopment Plan Area shall be in full force and effect from the date of this resolution until the first day of November , 2020, both dates inclusive, and said Rath -6- AHLERS.GOONEY.DOM%EILER.H.11\IE.s'ITH&.\LLBEE.P.C. Types of proposed renewal actions a: The City of Waterloo proposes to undertake an Urban Renewal Project under the provisions of Chapter 403 Code of Iowa, as amended to date. It is hereby found and declared that there exists in the proposed Rath Tax Increment Area, as described above, blighted conditions which impair its development, and the provision of municipal services necessary to maintain a healthy and safe community. Zoning and Land Use The existing and proposed zoning and land use are shown on the attached maps. The proposed changes will provide transitional areas and encourage the elimination of mixed uses. This will accommodate a more efficient and productive use of the land contained in the Rath Tax Increment Area. D. Other Provisions Necessary to meet state and local requirements • 1. ' In accordance with this Tax Increment Plan, • The City of Waterloo will take whatever action it deems necessary to close, vacate, plan or replan streets, roads, sidewalks, walkways or other places within the project area. 2. In the event it is deemed necessary for the successful implementation of the plan to acquire any properties, land acquisition procedures will be in conformance with . policies and procedures used in the City's acquisition programs. (current policy attached) 3. In the event any properties are acquired and it is necessary to relocate families, individuals or businesses, relocation assistance will be provided by the City's Community Development relocation staff. • 4. In the event that conformance with Federal and State requirements or funding conditions is necessary, the City may take whatever action is needed to comply. -,.. E. Acquisition of property would be undertaken only if rehabilitation of the property is impractical or properties - are needed for redevelopment by the City or another governmental agency, or to promote the orderly redevelopment and growth of the area. c. Disposition of property shall be consis- tent with the objectives of this plan. • 3. Rehabilitation and conservation • • a. Methods to be employed in achieving rehabilitation and conservation of the neighborhood. 1. Vigorous code enforcement will allow the area to develop/redevelop in an orderly and positive manner - - that will be beneficial to the neighborhood as well as the city as :.a. a whole. - 2. All relocation will be carried out in accordance with Iowa Code, Chapter 403.5, 4a (1989) . G. Project Funding • 1. Capital for demolition of the Rath site Capital for the Rath Redevelopment Project will be provided by 15 year General Obligation Bonds and any other City, State or Federal Monies which may become available. 2. Capital for neighborhood improvements • Capital to make neighborhood improvements will be • provided by one-half the increased tax increment revenues resulting from private investment in the Rath area and from the resale of the cleared property. 3. Debt service An increasing amount of the funds for debt service will be generated from the incremental taxes resulting from increased investment in the Rath area. Until the portion of the increment allocated to debt service is sufficient to provide positive cash flow the bonds will be backed by the full faith and credit of the municipality. II Project Budget A. Narrative The estimated cost for the demolition of the Rath site is $5,000,000 and the neighborhood improvements are estimated to be an additional $1,086,190. It is proposed to complete the demolition over a ten year • time period with bonds being issued at a rate of $475,000 the first year, $500,000 in years two through • nine and $525,000 in year ten. The amount of bonding - � necessary for demolition maydecreased be by State -•t. �,, ._. and/or Federal participation in the demolition expense. ~_ The success of the tax increment program is dependant upon the amount and timing of investment in the Rath Tax Increment area. Three projections are provided for `= the debt service on these bonds. Projection 1 assumes an increase of $6,300,000_ in the _ _ tax increment area assessed value over a twelve year BOOK 293 PAGE 893- _ _,. • period. For the first sixteen years of the project one half of the incremental tax will be used to service the debt and the remaining portion will be used for neighborhood improvements. This projection shows a positive cash flow from the increment in year twenty- one (2011) . Projection 2 assumes an increase of $9,300,000 in the tax increment area assessed value over a twelve year period. For the first fourteen years of the project one half of the incremental tax will be used to service the debt and the remaining portion will be used for neighborhood improvements. In year fifteen $72, 190 • will be used to complete the neighborhood improvements and the remainder will be used for debt service. This projection shows a positive cash flow from the increment in year nineteen (2009) . • • Projection 3 assumes an increase of $4,800,000 in the tax increment area assessed value over a fifteen year period. For the first nineteen years of the project one half of the incremental tax will be used to service the debt and the remaining portion will be used for neighborhood improvements. In year twenty $27,190 • will be used to complete the neighborhood improvements and the remainder will be used for debt service. This projection shows a positive cash flow from the • - - increment in year twenty-two (2012) . • B. Proposed Timing Schedule 1. With the ever increasing environmental concerns and regulations the longer the site remains in its deteriorating condition more regulations are likely to be placed which will add to the cost of removing the • buildings from the site which will in turn increase the cost of demolition as well as continuing to contribute to the blight in the neighborhood. To achieve the most timely • benefits we propose a phased approach as follows: '• Phase I demolition will include demolition of _ the East half of the Rath site as necessary.. • - - :< Estimated cost for Phase I is $550,000. Phase I will- be accomplished in 1991. `• Phase II demolition will include the r , " .;�" _ remainder of the Rath site. Estimated cost for Phase II is $4,450,000. Phase II will start in 1992 and will continue until • demolition is complete (anticipated completion date: December 2001) Federal and State participation in the funding will accelerate the demolition of the site and • BOOK ��� PAGE 894 -.- -_ • will make land available earlier for redevelopment and to contribute to the tax increment. Demolition of dilapidated structures and assembling land for future redevelopment will be financed or reimbursed with one-half of the incremental taxes. This will occur as need and funds dictate. These improvements will also include the acquisition and combination of smaller lots to eliminate conflicting/mixed uses. III Citizen Participation A. Community Development Board The Community Development Board secured a $4.5 million loan to Rath in 1980 by taking a mortgage on Waterloo Real Estate, machinery and equipment. The Company filed bankruptcy and liquidated in November 1985. The Mayor, by using the indebtedness as leverage, purchased the real estate for $400, 000. _ • Several small parcels were immediately sold to various companies. Following several attempts by the Mayor and City Council to sell the property to potential developers and making a payment to the County for back taxes, the Community Development -Board assumed responsibility again. The reason the Community Development Board has the responsibility is that all receipts must be used for Community Development activities. A consulting/engineering firm was retained by the Community Development Board to take a close look . at the buildings and site to determine the reuse possibilities. The study indicated that nearly all the buildings were obsolete and should be • demolished at an estimated cost of $3.5 to $5 million. The study also contained several alternatives to which buildings could remain. • T - The Mayor appointed a Blue Ribbon Committee to - = .:.. . .'review the study and select the best alternative. J _ This committee'reported that the best alternative ."3- y .12 vas total demolition with the exception of the I - - • Administration Building and the Maintenance = Building. The Community Development Board has been marketing the two buildings, looking for funds to clear the •_.. BOOT; 293 PACE 895 • site. At the same time plans have been prepared to replat the land as an industrial park. B. Rath Blue Ribbon Committee The committee recommended that the demolition of • the site be a two phase endeavor. The first phase should include the East portion of the Rath site. The committee recommended bonding to fund the demolition and a tax increment area along with the proceeds from the sale of land to cover the costs of debt service. It was the opinion of the committee that the city should act as the initial developer of the area; however, the city should transfer this role as soon as viable developer(s) from the private sector are available. • • Finally, the committee noted that demolition should begin as soon as possible; however, consideration must be given to the city's bonding capacity, public opinion and the anticipated rate of the site's redevelopment. C. Neighborhood meetings A neighborhood meeting was held June 27, 1990 from 7:00 to 9:00 p.m. at St. Johns school cafeteria. Approximately 100 interested citizens attended. Citizens were generally in favor of the plans for the Rath site and had many questions concerning the specifics of the plan and how it would impact their property. . IV Legal Data A. CITY OF WATERLOO, IOWA ACQUISITION CHECK LIST 1. City of Waterloo personnel determine property owners affected by the project. 2. City of Waterloo - Appraisers then inspect each property and make a written appraisal report on each property affected by the project. The appraisal report will estimate the current market value of the land and improvements to be purchased by the City of Waterloo, plus any reduction in the value of remaining property should its value be adversely affected. The appraiser will contact the property owner for permission to inspect and study the property. The appraiser will interview the land owner to get information about the use and operation of the property to be purchased by the City of Waterloo. 3. The appraiser's report will be reviewed by qualified review appraisers for the City of Waterloo. • 4. Property owner will then be contacted by an Acquisition Agent from the City of Waterloo to present the property owner with an 'offer to purchase". This dollar amount is offered as just compensation for property being purchased by the City of Waterloo. 5. After agreement is reached, a contract is approved and signed by the City. Where title conditions permit, a partial payment of the purchase price can also be made available per the term of the contract. 6. Reasonable time will be allowed for the occupant to vacate property • • purchased. Occupant will not be required to move sooner than ninety (90) days from the date the City makes the first offer to acquire the property. 7. Written notice specifying the date the property must be vacated will be given at least thirty (30) days prior to the required vacation date. The • thirty (30) day notice 'will not be issued until payment by the City is received as agreed, or the money has been deposited by the City as prescribed by law. �;.. - 8. The City Acquisition Agent will arrange payment at the earliest possible - - . date. 9. If the City's acquisition offer is rejected, fair market value will be determined in the course of eminent domain proceedings (commonly referred .to as condemnation). • r,• • • • '. • _ _ ._ . City of Waterloo - Relocation Agent will contact family/occupant to determine the amount of eligible relocation benefits such as: a) Actual reasonable expenses as a result of moving (based upon two (2) quotations from movers approved by City of Waterloo) . 3. To be eligible for assistance, occupant must not move until negotiations have started on the acquisition of the property without jeopardizing eligibility for moving cost payments. 4. If dissatisfied with the determination of the amount of payment offered under the Relocation Assistance Program, displacees may have the application reviewed by: a) Sending a written statement requesting the review and outlining the items in dispute to the Director, Planning & Development Division, City of Waterloo, 715 Mulberry, Waterloo, Iowa 50703. b) Stating the amount or amounts being claimed, if any, and including documentation and reasons why dissatisfied with the amount offered. 5. Upon receipt of your claim application, the Planning and Development • Director will appoint a review board and notify you when and where a hearing will be held. The review board will recommend a decision on your claim to the City of Waterloo. The Relocation Assistance Supervisor will • notify you in writing of the City of Waterloo's decision within one (1) week. • • • • • • • t - • • BOU 293 PAGE 9 Exhit- i + 8 " • A RESOLUTION APPROVING THE PROPOSED TAX INCREMENT FINANCING PLAN FOR THE FORMER RATH PACKING SITE AND SURROUNDING AREA WHEREAS, a Tax Increment Financing Plan has been proposed for demolition and site clearance of the former Rath Packing Company site; and WHEREAS, the plan is in conjunction with the revitalization of the area surrounding the Rath site; and WHEREAS, the proposed plan is in conformance with the Long Range Land Use Plan for the area; NOW THEREFORE, BE IT RESOLVED by the Planning, Programming and Zoning Commission of the City of Waterloo, Iowa, that the proposed Tax Increment Financing Plan for the . former Rath Packing Company site and surrounding area, is hereby approved and recommended to the City Council of the City of Waterloo, Iowa, for their approval.
