RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
CERTAIN EXCESS REAL PROPERTY TO CRYSTAL DISTRIBUTION
SERVICES FOR $60, 000 . 00, PLUS COSTS AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR
SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $60, 000 . 00 , plus costs, has been made by
Crystal Distribution Services, and
WHEREAS, a public hearing was held on November 5 , 1990, at
7: 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Crystal Distribution Services, Waterloo, Iowa,
and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, as follows :
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
October 26 , 1990, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose.
2 . That the offer of Crystal Distribution Services to
purchase real property for the sum of $60 , 000 . 00 and costs be,
and it is hereby accepted for property described below:
That part of Block Five ( 5 ) , Riverside Addition to Waterloo,
Iowa and that part of vacated Division Street and vacated
Rath Street, and that part of Block Two ( 2 ) , "Morning Side
Addition" , Waterloo, Iowa, along with the vacated alley
lying within said Block Two( 2 ) , described as follows:
Beginning at the Northwest corner of said Block Five ( 5 ) ;
thence S72°00 ' 00"E Three Hundred Seventy-eight and
Seventy-Six Hundredths ( 378.76 ) feet along the Northeasterly
line of said Block Five ( 5) to the point of intersection of
the Northwesterly extension of the Northeasterly line of
said Block Two ( 2 ) ; thence S65°14 ' 40"E Two Hundred
Fifty-three and Seventeen Hundredths ( 253 . 17) feet along the
Northeasterly line of said Block Two ( 2 ) ; thence
Southeasterly Eighty-eight and Three Hundredths ( 88 . 03 ) feet
along a Fifty ( 50 ) foot radius curve, concave Southwesterly
with a long chord of Seventy-seven and Nine Hundredths
( 77 . 09) feet which bears S14°48 ' 30"E; thence S35°37 ' 40"W Two
Hundred Fifty and Twenty-Two Hundredths ( 250 . 22) feet;
thence N54°2330"W Six Hundred Twenty-five and Seventeen
Hundredths ( 625. 17 ) feet to the Easterly line of vacated Elm
Street; thence N17°53 ' 00"E One Hundred Forty-three and
Ninety-four Hundredths ( 143 . 94 ) feet along said Easterly
line to the point of beginning, except that part deeded to
Crystal Ice and Cold Storage, Inc. , by the City of Waterloo,
Iowa, as recorded in CLD Book 600 at Page 547, Black Hawk
County Recorder ' s Office, said exception being described as
follows :

"Beginning at the Northwest Corner of said Block 5 , said
point beginning the Northwest Corner of former Rath building
number 131 ; thence South 72°0000" East 246. 07 feet along
the Southerly line of Sycamore Street; thence South
36°05 ' 00" West 211. 55 feet; thence North 54°23 ' 30" West
188. 97 feet to the Easterly line of vacated Elm Street;
thence North 17°53 ' 00" East 143 . 94 feet along said Easterly
line to the Point of Beginning, " all in the City of
Waterloo, Black Hawk County, Iowa.
Containing approximately 115, 265 square feet, and
Lot Twenty-five ( 25 ) , Block One ( 1 ) , "Morning Side
Addition" , all in the City of Waterloo, Black Hawk County,
Iowa.
Containing approximately 7 , 000 square feet.
3 . That the City of Waterloo, Iowa, convey said parcel of
real property to Crystal Distribution Services by Quit Claim
Deed.
4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver a deed to Crystal Distribution Services.
5 . That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6 . That the City Clerk is authorized and directed to
deliver said deed of conveyance to Crystal Distribution Services
upon receipt of the sum of $60 , 000 . 00 , and costs.
PASSED AND ADOPTED this 5th day of November, 1990.
