The tentative agenda for said meeting is as follows: Resolution determining the necessity and setting a date of hearing on a proposed Rath Urban Renewal Plan for a proposed Urban Renewal Area in the City of Waterloo. Such additional matters are set forth on the additional page (s) attached hereto. ATTORNEYS AT LAW DES MOINES,IOWA Council Member Brown then introduced the following proposed Resolution entitled "RESOLUTION DETERMINING THE NECESSITY AND SETTING A DATE OF HEARING ON A PROPOSED Rath URBAN RENEWAL PLAN FOR A PROPOSED URBAN RENEWAL AREA IN THE CITY OF WATERLOO" , and moved that the same be adopted. Council Member Wright seconded the motion to adopt. The roll was called and the vote was, AYES: Brown, Budak, Dell, Angel, Wright and Buck ABSENT Nam: Fox Whereupon, the Mayor declared the Resolution duly adopted as follows: RESOLUTION NO. 1990-628 RESOLUTION DETERMINING THE NECESSITY AND SETTING A DATE OF HEARING ON A PROPOSED RATH URBAN RENEWAL PLAN FOR A PROPOSED URBAN RENEWAL AREA IN THE CITY OF WATERLOO, IOWA WHEREAS, it is hereby found and determined that one or more blighted or economic areas, as defined in Chapter 403 , Code of Iowa, exist within the City and the rehabilitation, conservation, redevelopment, development, or combination thereof, of the area (s) is necessary in the interest of the public health, safety, or welfare of the residents of the City; and WHEREAS, this Council has reasonable cause to believe that the area described below satisfies the eligibility criteria for designation as an urban renewal area under Iowa law and has caused there to be prepared a proposed Rath Urban Renewal Plan for the area described therein, which proposed Plan is attached hereto as Exhibit A; and WHEREAS, this proposed Urban Renewal Area includes and consists of: Beginning at the point of intersection of the centerline of East Eleventh Street and the Northerly bank of the Cedar River, thence Northeasterly along the centerline of East Eleventh Street to its intersection with the centerline of Franklin Street, thence Southeasterly and Easterly along the centerline of Franklin Street to its intersection with the centerline of Vinton Street, thence Southerly along the centerline of Vinton Street to its intersection with the centerline of Sycamore Street, thence Southeasterly along the -2- AHLERS.COONEY,DORR'EILER.HAYNIE,SMITH&.ALLBEE,P.C. WHEREAS, the Iowa statutes require the City Council to submit the proposed Rath Urban Renewal Plan to the Planning and Zoning Commission for review and recommendation as to its conformity with the General Plan for development of the City as a whole, prior to City Council approval of such urban renewal plan and further provides that the Planning and Zoning Commission shall submit its written recommendations thereon to Council within thirty (30) days of its receipt of such proposed Rath Urban Renewal Plan; and WHEREAS, the Iowa statutes further require the City Council to hold a public hearing on an urban renewal plan for an urban renewal project subsequent to notice thereof by publication in a newspaper having general circulation within the City, which notice shall describe the time, date, place and purpose of the hearing, shall generally identify the urban renewal area covered by the urban renewal plan and shall outline the general scope of the urban renewal project under consideration. NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: 1. That a public hearing shall be held on the proposed Rath Urban Renewal Plan before the City Council at its meeting which commences at 7: 00 o'clock P .M. on November 19 , 1990, in the Council Chambers, City Hall, Waterloo , Iowa. 2 . ATTORNEYS AT LAW DES MOINES,IOWA (One Publication Required) NOTICE OF PUBLIC HEARING TO CONSIDER APPROVAL OF A PROPOSED RATH URBAN RENEWAL PLAN FOR A PROPOSED URBAN RENEWAL AREA IN THE CITY OF WATERLOO, IOWA The City Council of the City of Waterloo, Iowa, will hold a public hearing before itself at its meeting which commences at 7: 00 o'clock P .M. on November 19 n the Council Chambers, City Hall, Waterloo, Iowa to consider ladoption of a proposed Rath Urban Renewal Plan (the "Plan") concerning a proposed Urban Renewal Area in Waterloo, Iowa legally described as follows: Beginning at the point of intersection of the centerline of East Eleventh Street and the Northerly bank of the Cedar River, thence Northeasterly along the centerline of East Eleventh Street to its intersection with the centerline of Franklin Street, thence Southeasterly and Easterly along the centerline of Franklin Street to its intersection with the centerline of Vinton Street, thence Southerly along the centerline of Vinton Street to its intersection with the centerline of Sycamore Street, thence Southeasterly along the centerline of Sycamore Street to its intersection with the centerline of Dunham Place, thence Southerly along the centerline of Dunham Place and an extension of the centerline of Dunham Place to its intersection with the Cedar River, thence Northwesterly along the Northerly bank of the Cedar River to the point of beginning, which land is to be included as part of this proposed Urban Renewal Area. A copy of the Plan is on file for public inspection in the office of the City Clerk/Auditor, City Hall, Waterloo, Iowa. The City of Waterloo, Iowa is the local public agency which, if such Plan is approved, shall undertake the urban renewal activities described in such Plan. The general scope of the urban renewal activities under consideration in the Plan is to rehabilitate, conserve and redevelop land, buildings and other improvements within such area so as to improve the community through the establishment of effective land use controls, through use of an effective program of rehabilitation of existing buildings and elimination of those structures which cannot be economically rehabilitated, with a -4- AHLERS,COONEY,DORA EILER,HAYNIE,SMITH&ALLBEE.Y.C. The City may install, construct and reconstruct streets, parking facilities, open space areas and other substantial public improvements, and may acquire and make land available for development or redevelopment by private enterprise as authorized by law. The Plan initially proposes no specific acquisition parcels, but provides that the Plan may be amended from time to time to respond to development opportunities. Any person or organization desiring to be heard shall be afforded an opportunity to be heard at such hearing. The roll was called and the vote was, AYES: Dell , Angel, Buck, Wright, Budak and Brown ABSENT: XMA1N Fox Whereupon, the Mayor declared the resolution duly adopted as follows: RESOLUTION NO. 1990-629 RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSITION OF THE ISSUANCE OF $4 , 125, 000 SEWER REVENUE BONDS OF WATERLOO, IOWA AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS, the City of Waterloo, Iowa, is in need of funds to carry out the purpose hereinafter described; and, it is deemed necessary and advisable that said City should issue Sewer Revenue Bonds to the amount of $4 , 125, 000, as authorized by Section 384 . 83 , of the City Code of Iowa, for the purpose of providing funds to pay costs thereof; and WHEREAS, before said bonds may be issued, it is necessary to comply with the provisions of said Code, and to publish a notice of the proposal to issue such bonds and of the time and place of the meeting at which it is proposed to take action for the issuance of the bonds and to receive oral and/or written objections from any resident or property owner of said City to such action; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1.
