NOTICE AND CALL OF PUBLIC MEETING
Governmental Body: The City Council of Waterloo, Iowa.

Date of Meeting: September 24, 1990.
Time of Meeting: 7 : 00 o'clock P .M.
Place of Meeting: Council Chambers, City Hall, Waterloo, Iowa.
PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned
governmental body will meet at the date, time and place above set
out. The tentative agenda for said meeting is as follows:
Resolutions in connection with the Waterloo, Iowa, F.Y. 1990
Sidewalk Repair Assessment Program - Zone 1 - Contract No.
382 .
- Resolution accepting work.
- Resolution ordering preparation of
final plat and schedule of assessments.
Such additional matters as are set forth on the addi-
tional page(s) attached hereto.

Chapter 21, Code of Iowa, and the local rules of said governmental

The City Council of Waterloo, Iowa, met in Regular
session, in the Council Chambers, City Hall, Waterloo, Iowa, at
7: 00 o'clock P .M. , on the above date. There were present Mayor
Bernard L. McKinley, in the chair, and the following named Council
Members:
Brown, Dell, Buck, Fox, Angel, Wright
and Budak
Absent: None

Council Member Brown introduced the following
Resolution entitled "RESOLUTION ACCEPTING WORK" and moved its
adoption. Council Member Budak seconded the motion to
adopt. The roll was called and the vote was,
AYES: Brown, Dell , Buck, Fox, Angel,
Wright and Budak
NAYS: None
Whereupon the Mayor declared the following Resolution duly
adopted:
RESOLUTION NO. 1990-568
RESOLUTION ACCEPTING WORK
WHEREAS, on June 18, 1990, Waterloo, Iowa, entered into
contract with Cedar Valley Corporation of Waterloo, Iowa, for the
construction of the Waterloo, Iowa, F.Y. 1990 Sidewalk Repair
Assessment Program - Zone 1 - Contract No. 382 , within the City,
as therein described; and
WHEREAS, said Contractor has fully completed the construction
of said improvements, known as the Waterloo, Iowa, F.Y. 1990
Sidewalk Repair Assessment Program - Zone 1 - Contract No. 382, in
accordance with the terms and conditions of said contract and
plans and specifications, as shown by the Certificate of the
Engineer filed with the Clerk on
September 24 , 1990:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO , IOWA:
Section 1. That said report of the Engineer be and the same
is hereby approved and adopted and said improvements are hereby
accepted as having been fully completed in accordance with the
said plans, specifications and contract. The total contract cost
of the improvements payable under said contract is hereby
determined to be $ 49, 002 . 82
Section 2 . The total project cost including construction,
engineering, legal and administrative costs is determined to be
$ 58, 102 . 49

Council Member Brown introduced the following
Resolution entitled "RESOLUTION ORDERING PREPARATION OF FINAL PLAT
AND SCHEDULE OF ASSESSMENTS" and moved its adoption. Council
Member Budak seconded the motion to adopt. The roll
was called and the vote was,
AYES: Brown, Dell, Buck, Fox, Angel,
Wright and Budak
NAYS: None
Whereupon the Mayor declared the following Resolution duly
adopted:
RESOLUTION NO. 1990-569
RESOLUTION ORDERING PREPARATION OF FINAL
PLAT AND SCHEDULE OF ASSESSMENTS
BE IT RESOLVED, that the Engineer is hereby instructed to
prepare a final plat and schedule showing the separate lots or
parcels of ground subject to assessment for the cost of the
Waterloo, Iowa, F.Y. 1990 Sidewalk Repair Assessment Program -
Zone 1 - Contract No. 382, together with the names of the owners
thereof, so far as practicable, and the amount assessable by law
against each lot or parcel of ground so assessable, and against
any railway or street railway legally assessable therefor, and
95 . 85 % or $55, 688 . 65 of the whole amount of the cost of said
improvements shall be assessed against the benefited properties,
but not in excess of the amounts so assessed in the preliminary
plat and schedule for the improvement, and filed in the office of
the Clerk.

I, the undersigned City Clerk of Waterloo, Iowa, do hereby
certify that attached is a true and complete copy of the portion
of the corporate records of said Municipality showing proceedings
of the Council, and the same is a true and complete copy of the
action taken by said Council with respect to said matter at the
meeting held on the date indicated in the attachment, which
proceedings remain in full force and effect, and have not been
amended or rescinded in any way; that meeting and all action
thereat was duly and publicly held in accordance with a notice of
meeting and tentative agenda, a copy of which was timely served on
each member of the Council and posted on a bulletin board or other
prominent place easily accessible to the public and clearly
designated for that purpose at the principal office of the Council
(a copy of the face sheet of said agenda being attached hereto)
pursuant to the local rules of the Council and the provisions of
Chapter 21, Code of Iowa, upon reasonable advance notice to the
public and media at least twenty-four hours prior to the com-
mencement of the meeting as required by said law and with members
of the public present in attendance; I further certify that the
individuals named therein were on the date thereof duly and
lawfully possessed of their respective City Offices as indicated
therein, that no Council vacancy existed except as may be stated
in said proceedings, and that no controversy or litigation is
pending, prayed or threatened involving the incorporation,
organization, existence or boundaries of the City or the right of
the individuals named therein as officers to their respective
positions.
