RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION
CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND
ACCEPTING AND APPROVING CERTAIN DEEDS.
WHEREAS, the City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described
parcels is necessary to carry out the Big Rock Road
Reconstruction, Contract No. 395.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcels
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed
to pay for the properties and the incidental expenses necessary
to the consummation of the sales from City funds.
The subject parcels are:

Total Acquisition
That part of the East Fractional One-half (E Frl. 1/2) of
the Northwest Fractional One-Quarter (NW Frl. 1/4) of
Section Three ( 3 ) , Township Eighty-nine North (T89N) , Range
Thirteen West (R13W) of the Fifth Principal Meridian, City
of Waterloo, Black Hawk County, Iowa, described as follows:
The North Fifty-Three ( 53 . 0) feet of said East Fractional
One-half (E Fri. 1/2) except the South Twenty ( 20) feet of
the West Two Hundred (200) feet thereof , also excepting the
East Twenty-five ( 25. 0) feet thereof, said Twenty-five
( 25 . 0) feet being the right of way of the CC&P Railroad
( former WCF&N Rapid Transit Company) , the above described
parcel being subject to an existing Thirty-three ( 33 ) foot
roadway easement along the North side thereof, containing
64, 986 S.F. including 42,955 S.F. existing roadway easement.
Also, including that part of the Northwest Fractional
Quarter (NW Fri. 1/4) of the Northeast Fractional Quarter
(NE Fri. 1/4) of said Section Three ( 3) described as
follows:
The North Fifty-Three ( 53 . 0 ) feet of the West One Hundred
Four and Two Tenths ( 104. 2) feet of said Northwest
Fractional Quarter (NW Frl. 1/4) of the Northeast Fractional
Quarter (NE Frl. 1/4) except the West Twenty-five ( 25. 0)
feet thereof , said Twenty-five ( 25. 0) feet being the right
of way of the CC&P Railroad ( former WCF&N Rapid Transit
Company) , the above described parcel being subject to an
existing Thirty-three ( 33) foot roadway easement along the
North side thereof, containing 4,198 S.F. including 2,613
S.F. existing roadway easement, all in the City of Waterloo,
Black Hawk County, Iowa.
