RESOLUTION GRANTING PERMISSION TO ALVA ROKES, 2744 WEST
AIRLINE HIGHWAY, AND AUTHORIZING CONSTRUCTION OF ONE
( 1) TEMPORARY CONCRETE DRIVEWAY IRRESPECTIVE OF A LATER
OFFICIAL GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that:
WHEREAS, Alva Rokes, 2744 West Airline Highway, has made
written application to the City Council asking that he be
authorized and permitted to construct one ( 1) temporary concrete
driveway without respect to a permanent sidewalk grade when and
if the same may be subsequently set on 2744 West Airline Highway
and legally described as follows:
That part of the Southwest Quarter (SW 1/4) of the Southwest
Quarter (SW 1/4) of Section Four (4) , Township Eighty-nine
Nort.h (T89N) , Range Thirteen West (R13W) of the Fifth
Principal Meridian, in the City of Waterloo, Black Hawk
County, Iowa, described as follows:
Commencing at a point on the South line of said Southwest
Quarter ( SW 1/4) which is Two Hundred Twenty-eight and Three
Tenths ( 228. 3) feet West ' of the Southeast corner of said
Southwest Quarter of Southwest Quarter (SW 1/4 SW 1/4) ;
thence North Sixty ( 60. 0) feet to the pint of beginning;
thence continuing N 0°34 ' 30"E Three Hundred Thirty-eight and
Seven Hundredths ( 338 . 07) feet ( formerly described as "North
338. 2 feet" to the Southerly line of the Chicago Central and
Pacific Railroad; thence Northwesterly along said Southerly
lane, which is curved concave Southerly, a chord distance of
Two Hundred Nine and Eight Tenths (209.8) feet, bearing
N83°34 ' 20"W; thence S 0°00' 45"E Three Hundred Sixty-one and
Fifty-one Hundredths ( 361. 51) feet to the North line of
Airline Highway; thence N90°00'E Two Hundred Five ( 205.0)
feet to the point of beginning, all in the City of Waterloo,
Black Hawk County, Iowa,
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Alva Rokes, 2744 West Airline Highway, to
construct one ( 1) temporary concrete driveway in accordance with
the existing contour of the abutting land with the subjective
understanding and agreement between the City of Waterloo, Iowa,
and the said Alva Rokes that, should at a later date a permanent
formal grade be established for sidewalk purposes or otherwise,
that the said Alva Rokes will immediately thereafter, and at his
own expense, remove all or whatever portion of temporary concrete
driveway he may have constructed, and rebuild or reconstruct the
same in accordance with the permanent grade as may hereafter he
set and established, the work to be done under the supervision of
the City Engineer.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
