HomeMy WebLinkAbout1990-508-08.27.1990 RESOLUTION NO. 1990-508 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF THE NORTHEAST CORNER OF SAN MARNAN DRIVE AND LAPORTE ROAD TO ALBERT A. ALCODRAY AND ERICK ALCODRAY A/K/A ERIK ALCODRAY FOR $1. 00 AND OTHER CONSIDERATION, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1. 00 and other consideration, plus costs, has been made by Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodray, and WHEREAS, a public hearing was held on August 27, 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodray, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on August 17, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2. That the offer of Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodray to purchase real property for the sum of $1 . 00 and other consideration and costs be, and it is hereby accepted for property described below: All that part of the following described real estate located in Waterloo, Black Hawk County, Iowa, to-wit: Commencing at a point on the Northeasterly right of way line of U.S. Highway No. 218 which is 500. 8 feet South of the North line and 1023 . 6 feet West of the East line of the NE 1/4 of Section 2-88-13, said point being 60 feet Northeast from the centerline of said Highway No. 218 measured at right angles to said centerline; thence East on a line parallel to the North line of the NE 1/4 of said Section 2 a distance of 61. 35 feet to a point which is 110 feet from the centerline of said Highway no. 218 measured at right angles to said centerline; thence deflect right 54°35 ' on a line parallel to the centerline of said Highway No. 218 a distance of 557. 45 feet to a point 955. 1 feet South of the North line of the NE 1/4 of said Section 2; thence deflect right 125°25 ' on a line parallel to the North line of said NE 1/4 a distance of 61 . 35 feet to the Northeast right of way line of said Highway No. 218; thence deflect right 54°35 along said NE right of way line a distance of 557. 45 feet to the point of commencement. which is included in the real estate described as: That part of the Northeast Fractional Quarter of Section No. 2, Township No. 88 North, Range No. 13 West of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows: Resolution No. 1990-508 Page 2 n Commebdibg at the Northeast corner of said Section No. 2; then0 :South 00 degrees 40 minutes 00 seconds East 316.00 '--J feet along the East line of said Northeast Fractional ro , El Quarter; thence South 89 degrees 20 minutes 00 seconds West 8 650. 50 feet; thence South 89 degrees 22 minutes 30 seconds • West 295.70 feet to the point of beginning; thence South 89 degrees 22 minutes 30 seconds West 224.00 feet to the Northea#eily right-of-way line of LaPorte Road; thence South 35 degrees 54 minutes 30 seconds East along said 0., Northeasterly right-of-way line 239. 90 feet to the Northerly right-of-way line of East San Marnan Drive; thence South 88 rJ degrees 50 minutes 00 seconds East along said Northerly rigbt-of-way line 36. 48 feet; thence North 00 degrees 37 ' minutes 3G seconds West 24 . 19 feet; thence North 89 degrees 22 minutes 30 seconds East 32. 19 feet; thence North 00 degkees 37 minutes 30 seconds West 71. 03 feet; thence North 81. dOgtee'g 22 minutes 30 seconds East 16 .78 feet; thence NOrth. 00 degrees 37 minutes 30 seconds West 101.76 feet to the point of beginning. That the City of Waterloo, Iowa, convey said parcel of real EToperty- to Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodry by Quit Claim Deed. 4.. That the Mayor and City Clerk are hereby authorized to n ' execute hand deliver a deed to Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodray. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6 . That the City Clerk is authorized and directed to deliver said deed of conveyance to Albert A. Alcodray and Erick Alcodray a/k/a Erik Alcodray upon receipt of the sum of $1. 00 and other consideration, and costs . PASSED AND ADOPTED this 27th day of August, 1990.
