HomeMy WebLinkAbout1990-489-08.20.1990 RESOLUTION NO. 1990-489 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF FORMER CLEVELAND STREET RIGHT-OF-WAY GENERALLY LOCATED ADJACENT TO 1740 FALLS AVENUE TO STEAMBOAT GARDEN, INC. FOR $2,750. 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $2,750. 00, plus costs, has been made by Steamboat Garden, Inc. , and WHEREAS, a public hearing was held on August 20, 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Steamboat Garden, Inc. , Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on August 10, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of Steamboat Garden, Inc. to purchase real property for the sum of $2,750. 00 and costs be, and it is hereby accepted for property described below: That part of Lot 379, Galloway in the City of Waterloo, Iowa, described as follows: Beginning at the Northwest corner of said Lot 379; thence Southeasterly Seventeen and Eighty-five Hundredths ( 17 .85) feet to a point on a line which is Thirty-three ( 33. 0) feet normally distant, Westerly of the East line of Lot 378 in said Galloway, said point being Ten ( 10. 0 ) feet South of the Northeast line of Lot 379 as measured along said Thirty-three ( 33 . 0) foot parallel line; thence continuing South Sixty-eight and Ninety-five Hundredths ( 68 . 95) feet along said parallel line to the point of intersection with the East line of said Lot 379; thence Southwesterly Sixty-four and Forty-seven Hundredths ( 64. 47) feet to the Southwest corner of said Lot 379; thence Northeasterly to the point of beginning, containing 2,837 S.F. , all in the City of Waterloo, Black Hawk County, Iowa; 3 . That the City of Waterloo, Iowa, convey said parcel of real property to Steamboat Garden, Inc. by Quit Claim Deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver a deed to Steamboat Garden, Inc. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. Resolution No. 1990-489 Page 2 6 .
