RESOLUTION GRANTING PERMISSION TO RANDALL WALLACE, 2035
MITCHELL AVENUE AND AUTHORIZING CONSTRUCTION OF ONE ( 1 )
TEMPORARY CONCRETE DRIVEWAY IRRESPECTIVE OF A LATER
OFFICIAL GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that:
WHEREAS, Randall Wallace, 2035 Mitchell Avenue has made
written application to the City Council asking that he be
authorized and permitted to construct one ( 1) temporary concrete
driveway without respect to a permanent sidewalk grade when and
if the same may be subsequently set on 2035 Mitchell Avenue and
legally described as follows:
Unplatted Waterloo West part SE NE Sec 36 T 89 R 13 com at
SW cor SE NE said sec th E 274.4 ft along S line SE NE th N
1 deg 34 min W 79. 3 ft along existing row line U S 218 to pt
of beg th S 86 deg 20 1/2 min E 281. 8 ft along Nly row line
Mitchell Ave th N 21 deg 18 1/2 min W 569. 9 ft along Swly
row line CRI & P RR th W 88.1 ft th S 1 deg 34 min E 511. 6
ft along said Ely row line to pt of beg, all in the City of
Waterloo, Black Hawk County, Iowa,
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Randall Wallace, 2035 Mitchell Avenue, to
construct one ( 1) temporary concrete driveway in accordance with
the existing contour of the abutting land with the subjective
understanding and agreement between the City of Waterloo, Iowa,
and the said Randall Wallace that, should at a later date a
permanent formal grade be established for sidewalk purposes or
otherwise, that the said Randall Wallace will immediately
thereafter, and at his own expense, remove all or whatever
portion of temporary concrete driveway he may have constructed,
and rebuild or reconstruct the same in accordance with the
permanent grade as may hereafter be set and established, the work
to be done under the supervision of the City Engineer.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
