HomeMy WebLinkAbout1990-499-08.20.1990 RESOLUTION NO. 1990-499 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF OGDEN AVENUE BETWEEN DEARBORN AVENUE AND COTTAGE GROVE AVENUE FOR $560,00, PLUS COSTS TO PHILLIP HAMILTON, $280 .00, PLUS COSTS TO ALLAN D. AND QUESTEEN L. READ, AND $280. 00, PLUS COSTS, TO ROBERT L. AND DELLA P. VAN NEVELE AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $560. 00, plus costs, has been made by Phillip Hamilton, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $280. 00, plus costs, has been made by Allan D. and Questeen L. Read, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $280 . 00, plus costs, has been made by Robert L. and Della P. Van Nevele, and WHEREAS, a public hearing was held on August 13, 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Phillip Hamilton, Allan D. and Questeen L. Read, and Robert L. and Della P. Van Nevele, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on July 27, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of Phillip Hamilton to purchase real property for the sum of $560 .00 and costs be, and it is hereby accepted for property described below: The easterly 25 feet of vacated Ogden Avenue lying westerly of and adjacent to Lots 3 and 8 in Maywood Third Addition in the City of Waterloo, Black Hawk County, Iowa, with the City' s retention of a storm sewer easement over the entire parcel, 3 . That the offer of Allan D. and Questeen L. Read to purchase real property for the sum of $280 . 00 and costs be, and it is hereby accepted for property described below: The westerly 25 feet of vacated Ogden Avenue lying easterly of and adjacent to Lot 2, Maywood Third Addition in the City of Waterloo, Black Hawk County, Iowa, 4 . That the offer of Robert L. and Della P. Van Nevele to purchase real property for the sum of $280. 00 and costs be, and it is hereby accepted for property described below: The westerly 25 feet of vacated Ogden Avenue lying easterly of and adjacent to Lot 9, Maywood Third Addition in the City of Waterloo, Black Hawk County, Iowa, / BOCK 9 PACE 38 ,, Resolution No. 1.990-499 Page 2 That the City of Waterloo, Iowa, convey said parcels of real property to Phillip Hamilton, Allan D. and Questeen L. Read, and Robert L. and Della P. Van Nevele by Quit Claim Deed. 6. That the Mayor and City Clerk are hereby authorized to execute and deliver a deed to Phillip Hamilton, Allan D. and Questeen L. Read, and Robert L. and Della P. Van Nevele. 7 . That the original of said deeds fully executed and acknowledged is hereby approved and confirmed by the Council. 8. That the City Clerk is authorized and directed to deliver said deeds of conveyance upon receipt of said sums and costs. PASSED AND ADOPTED this 20th day of August, 1990. Bernard L.
