HomeMy WebLinkAbout1990-448-08.06.1990 RESOLUTION NO. 1990-448 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF EXCESS RIGHT-OF-WAY LOCATED ADJACENT TO 1827 ANSBOROUGH AVENUE AND HIGHWAY 63 TO JOHN DEERE COMMUNITY CREDIT UNION FOR $6, 606. 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND DEPUTY CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $6, 606. 00, plus costs, has been made by John Deere Community Credit Union, and WHEREAS, a public hearing was held on August 6, 1990, at 7 : 00 p.m. in. the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to John Deere Community Credit Union, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on July 20, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of John Deere Community Credit Union to purchase real property for the sum of $6, 606. 00 and costs be, and it is hereby accepted for property described below: A parcel of land located in the SW 1/4 of Section 27-89-13 described as follows: Beginning at the intersection of the Southerly extension of the Easterly line of Lot 16 of Lewis Miller' s Small Farms, Waterloo, Black Hawk County, Iowa with the Southeasterly line of the 20-foot alley (vacated) lying Southeasterly of said Lot 16 said Southeasterly alley line also being the former Northwesterly R-O-W line of the Chicago and North Western Transportation Company; thence continuing Southerly on the extension of the Easterly line of said Lot 16 a distance of 37 . 10 feet to a point that is 28. 50 feet normally distance from the Southeasterly line of said alley; thence Southwesterly parallel and 28. 50 feet normally distant from said Southeasterly alley line a distance of 463 . 58 feet to a point 10 feet Easterly of the Southerly extension of the Westerly line of Lot 19 of said Lewis Miller' s Small Farms also being the Easterly R-O-W line of Ansborough Avenue; thence Northerly parallel with said Southerly extension of the Westerly line of said Lot 19 a distance of 37. 10 feet to said Southeasterly alley line; thence Northeasterly along said Southeasterly alley line a distance of 463 . 58 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. 3 . That the City of Waterloo, Iowa, convey said parcel of real property to John Deere Community Credit Union by Quit Claim Deed. 4. That the Mayor and Deputy City Clerk are hereby authorized to execute and deliver a deed to John Deere Community Credit Union. Resolution No. 1990-448 Page 2 tti T - > ' —1 i-- S. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council.
