HomeMy WebLinkAbout1990-445-07.23.1990 RESOLUTION NO. 1990-445 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF BIRMINGHAM AVENUE RIGHT-OF-WAY TO VIC FULLER SALVAGE & WRECKING COMPANY FOR $598 . 40, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $598 . 40, plus costs, has been made by Vic Fuller Salvage & Wrecking Company, and WHEREAS, a public hearing was held on July 9, 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Vic Fuller Salvage & Wrecking Company, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on June 29, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of Vic Fuller Salvage & Wrecking Company to purchase real property for the sum of $598 . 40 and costs be, and it is hereby accepted for property described below: The part of the Southeast 1/4 of the Northeast 1/4 of Section 36, Township 89, Range 13 West of the 5th P.M. in the City of Waterloo, Iowa, lying within the following described boundaries: Commencing at a point 8 . 641 chains West of the Southeast corner of the Northeast 1/4 of Section 36, Township 89 North, Range 13 West of the 5th P.M. ; thence north 6 . 48 chains, thence west 4. 223 chains to the Northeasterly line of the right-of-way of the Chicago, Rock Island & Pacific Railway Company, which shall be the point of beginning; thence northwesterly along said Northeasterly right-of-way line to the intersection of the Westerly extension of the North lot line of Lot 11, Block 106, in Riverview Addition of the City of Waterloo, Black Hawk County, Iowa; thence east along said extension to the Northwesterly corner of said Lot 11, thence southeasterly along the Southwesterly lot line of Lots 11, 12 and 13 and/or the extension thereof to a point due East of the point of beginning, thence west to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. 3 . That the City of Waterloo, Iowa, convey said parcel of real property to Vic Fuller Salvage & Wrecking Company by Quit Claim Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver a deed to Vic Fuller Salvage & Wrecking Company. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. Resolution No. 1990-445 Page 2 6 .
