HomeMy WebLinkAbout1990-350-06.11.1990 (2) RESOLUTION NO. 1990-350 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF LITCHFIELD AVENUE TO B. SCHULTZ COMPANY AND ARLENE E. EILERS FOR $257 . 80 EACH, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $257 . 80, plus costs, has been made by B. Schultz Company and Arlene E. Eilers, and WHEREAS, a public hearing was held on June 11 , 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to B. Schultz Company and Arlene E. Eilers, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on June 4, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of B. Schultz Company to purchase real property for the sum of $257 . 80 , and costs be and it is hereby accepted for property described below: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89, Range 13 West of the 5th P.M. in Black Hawk County described as follows: Beginning at the Northeast corner of Lot 10 Block 2 Litchfield First Addition, thence West along the North line of said lot 68. 2 ' , thence North 14. 5 ' thence East 68 .2 ' along a line parallel to the North line of Lot 10 Block 2 Litchfield First Addition, thence South 14 . 5 ' to the point of beginning, all in the city of Waterloo, Black Hawk County, Iowa, subject to the City' s retention of a permanent utility easement over, under and above the Northerly 1 . 5 feet of said parcel, all in the City of Waterloo, Black Hawk County, Iowa, 3 . That the offer of Arlene E. Eilers to purchase real property for the sum of $257 . 80, and costs be and it is hereby accepted for property described below: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89, Range 13 West of the 5th P.M. in Black Hawk County described as follows: Commencing at the Northeast corner of Lot 10 Block 2 Litchfield First Addition, thence North 14. 5 ' along the westerly line of Columbia Street extended to the point of beginning, thence continuing north 14 . 5 ' on the last described course, thence west 68. 2 ' along the North right-of-way of Litchfield Avenue, thence south 14. 5 ' , thence east 68. 2 ' along a line that is parallel to the North line of Lot 10 Block 2 Litchfield First Addition to the point of beginning, all in the City of Waterloo, Black Hawk Resolution No. 1990-350 Page 2 County, Iowa, subject to the City' s retention of a permanent utility easement over, under and above the entire parcel, all in the City of Waterloo, Black Hawk County, Iowa. 4 . That the City of Waterloo, Iowa, convey said parcel of real property to B. Schultz Company and Arlene E. Eilers by Quit Claim Deed. 5. That the Mayor and City Clerk are hereby authorized to execute and deliver a deed to B. Schultz Company and Arlene E. Eilers. 6 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 7 . That the City Clerk is authorized and directed to deliver said deed of conveyance to B. Schultz Company and Arlene E. Eilers upon receipt of the sum of $257. 80 each, and costs.
