RESOLUTION GRANTING PERMISSION TO GLENN E. KUEHL, 1121
CHALMERS STREET, AND AUTHORIZING CONSTRUCTION OF ONE
( 1) TEMPORARY CONCRETE DRIVEWAY IRRESPECTIVE OF A LATER
OFFICIAL GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that:
WHEREAS, Glenn E. Kuehl, 1121 Chalmers Street, has made
written application to the City Council asking that he be
authorized and permitted to construct one ( 1) temporary concrete
driveway without respect to a permanent sidewalk grade when and
if the same may be subsequently set on 1121 Chalmers Street and
legally described as follows:
Downing Place Wloo Lot 10 Blk 17 Lot 11 Blk 17 exc that prt
of Lots 10 & 11 lying SEly of a line desc as com at NE Cor
Lot 10 th to a pt on S Line Lot 10 which is 87 ft E of SW
cor Lot 10 th said line is drawn to A pt 21. 5 ft N & 72. 5 ft
E of SW cor Lot 11 th said line is continued to a pt on S
line Lot 11 which is 48 ft E of SW cor Lot 11, all in the
City of Waterloo, Black Hawk County, Iowa
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Glenn E. Kuehl to construct one ( 1) temporary
concrete driveway in accordance with the existing contour of the
abutting land with the subjective understanding and agreement
between the City of Waterloo, Iowa, and the said Glenn E. Kuehl
that, should at a later date a permanent formal grade be
established for sidewalk purposes or otherwise, that the said
Glenn E. Kuehl will immediately thereafter, and at his own
expense, remove all or whatever portion of temporary concrete
driveway he may have constructed, and rebuild or reconstruct the
same in accordance with the permanent grade as may hereafter be
set and established, the work to be done under the supervision of
the City Engineer.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this llth day of June, 1990.
