HomeMy WebLinkAbout1990-268-05.07.1990 RESOLUTION NO. 1990-268 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CERTAIN EXCESS RIGHT-OF-WAY TO HERBERT F. IDE FOR $18, 500. 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $18, 500. 00, plus costs, has been made by Herbert F. Ide, and WHEREAS, a public hearing was held on May 7 , 1990 , at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Herbert F. Ide, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on April 20, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2 . That the offer of Herbert F. Ide to purchase real property for the sum of $18 , 500 . 00 and costs be, and it is hereby accepted for property described below: All that part of the West 1/2 of the Southwest 1/4 of Section 21 , Township 89 North, Range 13 West of the 5th Principal Meridian, Waterloo, Black Hawk County, Iowa, lying East of Greenhill Road and North of University Avenue, described as follows: Beginning at a point on the North line of said Southwest 1/4, which is 696. 99 feet East of the Northwest corner of said Southwest 1/4; thence South 30°24 ' 36" East, 72. 51 feet; thence South 09°45 ' 26" East, 472. 36 feet; thence continuing South 09°45 ' 26" East, 472 . 37 feet to a point that is 80. 00 feet radially distant Northeasterly of the center line of University Avenue; thence South 59°33 ' 00" East, 75. 94 feet to a point that is 70. 00 feet radially distant Northeasterly of the center line of University Avenue; thence North 00°18 ' 33" East, 546. 69 feet along the West line of the East 375 . 00 feet of the West 1/2 of said Southwest 1/4; thence continuing North 00°18 ' 33" East, 483 . 52 feet along the West line of the East 375 . 00 feet of the West 1/2 of said Southwest 1/4 to a point on the North line of said Southwest 1/4; thence North 89°35 ' 41" West, 267. 84 feet to the point of beginning. The West line of said Southwest 1/4 is assumed to bear North 0°00 ' 00" East, all in the City of Waterloo, Black Hawk County, Iowa. Containing approximately 3 . 55 acres or 154, 621. 6 S.F. 3 . That the City of Waterloo, Iowa, convey said parcel of real property to Herbert F. Ide by Quit Claim Deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver a deed to Herbert F. Ide. Resolution No. 1990-268 Page 2 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Herbert F. Ide upon receipt of the sum of $18,500. 00, and costs. PASSED AND ADOPTED this 7th day of May, 1990.
