Date of Meeting: April 23 , 1990. Time of Meeting: 7 : 00 o'clock P .M. Place of Meeting: Council Chambers, City Hall, Waterloo, Iowa. PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date, time and place above set out. The tentative agenda for said meeting is as follows: Procedure to initiate the Waterloo, Iowa, F.Y. 1990 Sidewalk Repair Assessment Program - Zone 1 - Contract No. 382 . - Preliminary resolution for construction. - Resolution fixing values of lots. - Resolution adopting preliminary plat and schedule, estimate of cost and proposed plans and specifications. - Resolution of necessity (Proposed) . Such additional matters as are set forth on the addi- tional page(s) attached hereto. There were present Mayor Bernard L. McKinley , in the chair, and the following named Council Members: Buck, Fox, Budak, Dell, Wright, Angel and Brown Absent: None * * * * * * * - 1 - AHLERS,COONEY,DORWEILER,HAYNIE,SMITH&ALLBEE,P.C. ATTORNEYS AT LAW DES MOINES,IOWA Buck introduced the following Resolution entitled "PRELIMINARY RESOLUTION FOR THE CONSTRUCTION OF SIDEWALK IMPROVEMENTS IN THE CITY OF WATERLOO, IOWA" , and moved its adoption. Wright seconded the motion to adopt. The roll was called and the vote was, AYES: Dell, Brown, Buck, Budak, Fox, Wright and Angel NAYS: None Whereupon, the Mayor declared the Resolution duly adopted as follows: RESOLUTION NO. 1990-223 (CONTRACT NO. 382) PRELIMINARY RESOLUTION FOR THE CONSTRUCTION OF SIDEWALK IMPROVEMENTS IN THE CITY OF WATERLOO, IOWA WHEREAS, this Council, after a study of the requirements, is of the opinion that it is necessary and desirable that municipal sidewalk repair work, together with necessary related work be constructed within Waterloo, Iowa, as hereinafter described; and WHEREAS, it is proposed that said project be constructed as a single improvement under the authority granted by Division IV of Chapter 384 of the City Code of Iowa: NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: Subdivision A. That Waterloo, Iowa, construct municipal sidewalk repair work, together with necessary related work, as hereinafter described. Subdivision B. The beginning and terminal points of said improvements shall be as follows: - 2 - AHLERS,COONEY,DORWEILER,HAYNIE,SMITH&ALLBEE,P.C. ATTORNEYS AT LAW DES MOINES,IOWA WATERLOO, IOWA, F.Y. 1990 SIDEWALK REPAIR ASSESSMENT PROGRAM - ZONE 1 - CONTRACT NO. 382 Construction of municipal sidewalk repair work, together with necessary related work, at various locations throughout the City. The exact locations are set out in detail in the preliminary assessment plat on file in the office of the City Clerk/Auditor, and said plat by this reference is made a part hereof. Subdivision C. That the City Engineer of Waterloo, Iowa, having been employed as Engineer to prepare plats, schedules, estimates, plans and specifications and otherwise to act in said capacity with respect to said project is hereby ordered to prepare and file with the Clerk preliminary plans and specifications and estimates of the total cost of the work and the plat and schedule of special assessments against benefited properties. Subdivision D. That this Council hereby determines that all property within the area hereinafter described will be specially benefited by said improvements, to-wit: All properties, any part of which is included within the areas located along the streets and avenues to be improved and generally described so as to include all privately owned and assessable property abutting the sidewalks to be repaired, as more particularly shown on the assessment plat on file in the City Clerk/Auditor' s Office. (Waterloo, Iowa, F.Y. 1990 Sidewalk Repair Assessment Program - Zone 1 - Contract No. 382) Subdivision E. The said improvement shall be designated as the "Waterloo, Iowa, F.Y. 1990 Sidewalk Repair Assessment Program - Zone 1 - Contract No. 382" , and such name shall be a sufficient designation to refer to said improvement in all subsequent proceedings. Subdivision F. That the Resolutions adopted by the Council at their meeting on April 9, 1990, entitled "RESOLUTION WITH RESPECT TO THE ADOPTION OF THE RESOLUTION OF NECESSITY PROPOSED FOR THE WATERLOO, IOWA, F.Y. 1990 SIDEWALK REPAIR ASSESSMENT PROGRAM - ZONE 1 - CONTRACT NO. 382" , the "RESOLUTION DIRECTING PREPARATION OF DETAILED PLANS AND SPECIFICATIONS, FORM OF CONTRACT AND NOTICE TO BIDDERS ON THE WATERLOO, IOWA, F.Y. 1990 SIDEWALK REPAIR ASSESSMENT PROGRAM - ZONE 1 - CONTRACT NO. 382" and the "RESOLUTION ORDERING BIDS, APPROVING PLANS, SPECIFICATIONS AND - 3 - AHLERS,COONEY.DORWEILER,HAYNIE,SMITH&ALLBEE,P.C. ATTORNEYS AT LAW DES MOINES,IOWA FORM OF CONTRACT AND NOTICE TO BIDDERS, FIXING AMOUNT OF BID SECURITY, AND ORDERING CLERK TO PUBLISH NOTICE AND FIXING A DATE FOR RECEIVING SAME, AND FOR A PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST", be and the same are hereby repealed since the Resolution of Necessity for said project, as amended by the Council, did not receive an affirmative vote of three-fourths of all members of the Council, as required by Section 384 .51 of the City Code of Iowa.
