RESOLUTION APPROVING CERTAIN PERMANENT EASEMENT
AGREEMENTS WITH WEISSMAN IRON AND METAL, INC. AND
WEISSMAN STEEL SUPPLY, INC. , AND AGREEMENT WITH
IOWA DEPARTMENT OF TRANSPORTATION
WEISSMAN' S
INDUSTRIES AND DIRECTING EXECUTION OF SAID
AGREEMENTS BY MAYOR.
WHEREAS, Weissman Iron and Metal, Inc. is purchasing
property adjacent to the below described parcel, and
WHEREAS, Weissman Iron and Metal, Inc. wishes to
construct a proposed railroad spur track across the
following described parcel:
(Area "A" )
That part of the existing Airline Highway right of way
lying in that part of the Southwest Quarter (SW 1/4) of
Section Three ( 3) , Township Eight-nine North (T89N) ,
Range Thirteen West (R13W) of the Fifth Principal
Meridian, in the City of Waterloo, Black Hawk County,
Iowa, described as follows:
Beginning at the Southeast corner of said Southwest
Quarter (SW 1/4) ; thence N 0°00 ' 00"E One Hundred Thirty
( 130) feet along the East line of said Southwest
Quarter (SW 1/4) ; thence S88°46' 30"W Twenty-five ( 25)
feet to a point which is common to both the Northerly
line of said Airline Highway and the West line of the
CC&P Railroad; thence S43°32' 42"W Ninety-eight and
Fifty-seven Hundredths ( 98. 57 ) feet along said
Northerly line to a point which is Sixty ( 60) feet
normally distant, and Northerly of the South line of
said Southwest Quarter ( SW 1/4) ; thence S88°46' 30"W
Fifty ( 50) feet parallel with said South line; thence
S22°37 ' 16"E Sixty-four and Forty-three Hundredths
( 64. 43) feet to said South line; thence N88°46' 30"E One
Hundred Eighteen and Fifteen Hundredths ( 118 . 15) feet
to the point of beginning.

That part of the existing Airline Highway right of way
lying on that part of the Northwest Quarter (NW 1/4) of
Section Ten ( 10) , Township Eight-nine (T89N) , Range
Thirteen West (R13W) of the Fifth Principal Meridian,
in the City of Waterloo, Black Hawk County, Iowa,
described as follows:
Beginning at the Northeast corner of said Northwest
Quarter (NW 1/4) ; thence S 1°15 ' 30"E One Hundred Thirty
( 130) feet along the East line of said Northwest
Quarter (NW 1/4) ; thence S88°46 ' 30"W Twenty-five ( 25)
feet to a point which is common to both the Southerly
line of said Airline Highway and the West line of the
CC&P Railroad; thence N47°24 ' 45"W Ninety-three and
Eight-nine Hundredths (93 . 89) feet along said Southerly
line to a point which is Sixty-five ( 65) feet normally
distant and Southerly of the North line of said
Northwest Quarter (NW 1/4) ; thence N22°37' 16"W
Sixty-nine and Eighty-one Hundredths ( 69.81) feet to
the North line of said Northwest Quarter (NW 1/4) ;
thence N88°46' 30"E One Hundred Eighteen and Fifteen
Hundredths ( 118. 15) feet to the point of beginning, all
in the City of Waterloo, Black Hawk County, Iowa.

WHEREAS, Weissman Steel Supply, Inc. proposes to
purchase property adjacent to property owned by the City of
Waterloo and requires access to said property by way of a
driveway over the following legally described property:
That part of the former C&NW Transportation Company
right of way lying in that part of the Southwest
Quarter (SW 1/4) of Section Thirty-three ( 33 ) , Township
Eight-nine North (T89N) , Range Thirteen West (R13W) of
the Fifth Principal Meridian, in the City of Waterloo,
Black Hawk County, Iowa, described as follows:
Commencing at a point on the West line of said
Southwest Quarter (SW 1/4) which is Nine Hundred
Forty-three and Fifty-nine Hundredths ( 943. 59) feet
North of the Southwest corner of said Southwest Quarter
( SW 1/4) ; thence N90°00 'E Nine Hundred Three and
Thirty-two Hundredths ( 903 . 32) feet to the
Northwesterly line of said former right of way; thence
N36°45 ' 03"E Four Hundred Ninety-six and Forty-two
Hundredths ( 496 .42) feet along said right of way line
to the point of beginning; thence Southeast at right
angles One Hundred ( 100) feet to the Northwesterly
right of way line of U.S. Highway No. 63; thence
Northeasterly Two Hundred ( 200) feet along said right
of way line; thence Northwesterly at right angles One
Hundred ( 100) feet to said former right of way line;
thence Southwesterly along said former right of way
line Two Hundred ( 200) feet to the point of beginning,
all in the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WATERLOO, IOWA, that the Agreements for
Permanent Easement between Weissman Steel Supply, Inc. and
Weissman Iron and Metal, Inc. and the City of Waterloo, Iowa
are hereby approved arid the Mayor authorized to execute the
same in behalf of the City of Waterloo, Iowa.
BE IT FURTHER RESOLVED that the agreement between
Weissman Industries, the Iowa Department of Transportation
and the City of Waterloo for a median cut at U.S. Highway 63
to provide access for a driveway from Highway 63 to
Weissman' s business, be and the same is hereby approved and
the Mayor authorized to execute the same on behalf of the
City of Waterloo, Iowa.
PASSED AND ADOPTED this 23rd day of April, 1990.
