RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
CITY-OWNED PROPERTY LOCATED AT THE NORTHEAST CORNER OF
UNIVERSITY AVENUE AND MIDWAY DRIVE TO SMITTY'S TRAILER
VILLAGE, INC. FOR $9, 684. 00, PLUS COSTS, AND TO TRACTOR
SUPPLY CO. FOR $13,141.66, PLUS COSTS AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED
FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $9, 684.00, plus costs, has been made by
Smitty' s Trailer Village, Inc. , and $13, 141. 66, plus costs, has
been made by Tractor Supply Co. , and
WHEREAS, a public hearing was held on March 5, 1990, at 7: 00
p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Smitty's Trailer Village, Inc. and Tractor
Supply Co. , Waterloo, Iowa, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, as follows:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
February 16, 1990, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose.
2. That the offer of Smitty' s Trailer Village, Inc. to
purchase real property for the sum of $9,684.00 and costs be, and
it is hereby accepted for property described below:
A parcel of land located in the west 116 ft. of Lot 7 of the
Centennial 2nd Add. , City of Waterloo, Black Hawk County,
Iowa, as shown on Right of Way Plat Exhibit "A" attached and
by reference made a part hereof .
The centerline of Primary Road No. 218 designated by station
points 100 ft. apart numbered consecutively from west to
east is described as follows: Beginning at Sta. 2397+37.7 a
point N 0 degrees 00 ' E 866. 4 ft. from the W 1/4 Cor. Sec.
20, T89N, R13W on the west line said Sec. 20, thence S68
degrees 07 ' E 1483 . 9 ft. to Sta. 2412+21 . 6; thence S 74
degrees 18 ' E 2297. 4 ft. to Sta. 2429+00.
Said parcel is described as follows: All that part of the
west 116 ft. of Lot 7, lying north of a line 100 ft.
normally distant northeasterly from the above described
centerline of Primary Road No. US 218 and south of a line
130 ft. normally distant northeasterly from said centerline,
said parcel contains 3620 Sq. Ft. , more or less. Note: The
west line of the NW 1/4 Sec. 20, T89N, R 13 W is taken as
being due north, subject to a 35 ft. wide sanitary sewer
easement along the westerly side of said parcel, all in the
City of Waterloo, Black Hawk County, Iowa.
3 . That the offer of Tractor Supply Co. to purchase real
property for the sum of $13,141. 66 and costs be, and it is hereby
accepted for real property described below:

A parcel of land located in the west 116 ft. of Lot 7 of the
Centennial 2nd Add. , City of Waterloo, Black Hawk County,
Iowa, as shown on Right of Way Plat Exhibit "A" attached and
by reference made a part hereof .

distant northeasterly from the above described centerline of
Primary Road No. US 218 and south of a line 100 ft. normally
distant northeasterly from said centerline, Except,
commencing at a point on the westerly line Lot 7 Centennial
Second Addition that is sixty-five ( 65) ft. normally distant
northeasterly from the above described centerline Primary
Road U.S. 218, thence northerly along the Westerly Line Lot
7 to a point that is one hundred ( 100) feet normally distant
northeasterly from above described centerline thence
southeasterly to a point sixty-five ( 65) ft. normally
distant northeasterly of centerline Primary Road U.S. 218
and five ( 5 ) feet southeasterly of point of beginning thence
northwesterly five ( 5) ft. to point of beginning, subject to
a 35 ft. wide sanitary sewer easement along the westerly
side of said parcel, said parcel contains 4135 Sq. Ft. , more
or less. Note: The west line of the NW 1/4 Sec. 20, T89N,
R 13 W is taken as being due north.
4. That the City of Waterloo, Iowa, convey said parcel of
real property to Smitty' s Trailer Village, Inc. and Tractor
Supply Co. by Quit Claim Deed.
5 . That the Mayor and City Clerk are hereby authorized to
execute and deliver a deed to Smitty's Trailer Village, Inc. and
Tractor Supply Co.
6. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
7 . That the City Clerk is authorized and directed to
deliver said deed of conveyance to Smitty' s Trailer Village, Inc.
upon receipt of the sum of $9,684. 00, and costs, and to Tractor
Supply Co. upon receipt of the sum of $13 , 141. 66, and costs.
PASSED AND ADOPTED this 5th day of March, 1990.
