HomeMy WebLinkAbout1990-056-02.05.1990 RESOLUTION NO. 1990-56 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED NORTH OF VACATED EASTON AVENUE AND EAST OF I-380 TO SECURITY HOUSE, INC. (UNITED AUTO WORKERS LOCAL 838) FOR $38,926. 00, PLUS COSTS AND AUTHORIZING THE MAYOR PRO TEM AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $38, 926. 00, plus costs, has been made by Security House, Inc. (United Auto Workers Local 838) , and WHEREAS, a public hearing was held on February 5, 1990, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Security House, Inc. (United Auto Workers Local 838 ) , Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on January 26, 1990, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose. 2. That the offer of Security House, Inc. (United Auto Workers Local 838) to purchase real property for the sum of $38, 926. 00 and costs be, and it is hereby accepted for property described below: A parcel of land located in the Southeast Quarter of Section 36, Township 89, Range 13 in the City of Waterloo, Black Hawk County, Iowa, described as follows: Beginning at the point of intersection of the northerly line of vacated Easton Avenue with the easterly line of I-380, thence N89 degrees 13 ' 30" E along the northerly line of vacated Easton Avenue 527. 86 ' thence N 21 degrees 18 ' 49" W 228 . 3 ' along a line 100 feet southwesterly of and parallel with the Iowa Northern Railroad, thence westerly parallel to the northerly line of vacated Easton Avenue a distance of 531. 64 ' to the easterly line of I-380, thence S 19 degrees 13 ' 29" E 178 . 4 ' along said easterly line, thence S 32 degrees 22 ' 10" E 52. 32 feet to point of beginning, subject to the City's retention of a permanent utility easement located over, under and above the following described property: Commencing at the point of intersection of the northerly line of vacated Easton Avenue and the easterly line of 1-380, thence N 89 degrees 13 ' 30" E 341. 53 feet to the point of beginning, thence continuing N 89 degrees 13 ' 30" E 43 . 17 feet thence N 21 degrees 10 ' W to the north line of the previously described property, thence S 89 degrees 13 ' 30" W 43 . 17 feet, thence S 21 degrees 10 ' E to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa . That the Mayor Pro Tem and City Clerk are hereby authorized to execute and deliver a deed. to Security House, Inc. (United Auto Workers Local 838) . 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Security House, Inc. (United Auto Workers Local 838) upon receipt of the sum of $38,926.00, and costs.
