AND W . 10TH STREET IN THE AREA BORDERED BY THE CEDAR RIVER AND COMMERCIAL STREET FOR USE AS AN INDOOR SPORTS FACILITY. WHEREAS , Vern and Donna Nelson of Waterloo , Iowa , are owners of real property in the City of Waterloo , Iowa , as described below , and WHEREAS , the City of Waterloo , Iowa , is interested in constructing an Indoor Sports Facility, a study of which was conducted by the Citizen ' s Recreation Facility Committee , and WHEREAS , said owners have offered said property for use by the City of Waterloo for an Indoor Sports Facility , NOW , THEREFORE , IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO , IOWA as follows : 1 . The following described real property be conveyed to the City of Waterloo , for the express purpose of use as an indoor Sports Facility , 2 . That said conveyance be and the same is hereby accepted for real property described below: All that part of Lots Nos . Forty-one (41 ) , Forty-two (42 ) , Forty-three (43) , Forty-four ( 44) and Forty-five ( 45 ) in Fractional Block No. Nine ( 9) , in the Original Plat , on the West Side of the Cedar River, in the City of Waterloo , Black Hawk County , Iowa , lying Southwesterly of the River Front Improvement Commission line , except the right of way of the Chicago Great Western Railroad and except that part thereof condemned for flood control project by the City of Waterloo by Condemnation Proceedings recorded in Deed Record 526 at page 813 of the records of said county ; and All that part of vacated West Ninth in the City of Waterloo , Iowa , lying Northeast of the Southwest lines extended of Lot No. Forty-five (45) in Fractional Block No. Nine (9) , and Lot No. Forty-six (46 ) in Fractional Block No. Ten ( 10 ) , in the Original Plat , on the West Side of the Cedar River , Black Hawk County , Iowa , and lying Southwesterly of the River Front Improvement Commission line , except the Right of Way of the Chicago Great Western Railroad , except that part thereof condemned for flood control project by the City of Waterloo by Condemnation Proceedings recorded in Deed Record 526 at page 813 of the records of said county , and except that part thereof bounded as follows : Commencing at the most Westerly corner of Lot No . Forty-six (46) , in said Fractional Block No. Ten ( 10) ; thence Northwesterly along an extension of the Southwesterly line of said Lot No. Forty-six ( 46 ) to a point which is Thirteen and Six Hundredths ( 13 . 06 ) feet Southeasterly of the most Southerly corner of Lot No. Forty-five ( 45 ) in said Fractional Block No. Nine ( 9) ; thence Northeasterly along a line which is parallel with the Southeasterly line of said Lot No. Forty-five (45 ) a distance of One Hundred Ninety-six ( 196 ) feet ; thence Southeasterly at an angle of Ninety ( 90 ) degrees two (2 ) minutes to the right a distance of Sixty-six and Ninety-four Hundredths ( 66 . 94 ) feet to a point in the Northwesterly line of said Lot No . Forty-six (46 ) ; thence Southwesterly along the Northwesterly line of said Lot No . Forty-six (46 ) to the place of beginning . 3. That said real property revert back to Vern and Donna Nelson in the event that said facility is not constructed within four (4) years of date of this action .
