WHEREAS, it has been proposed that the Council of the City of Waterloo, Iowa, approve the request of Nagle Signs for a minor Site Plan Amendment to the "R -4,C -Z" Conditional Zoning District for an addition to an existing freestanding sign causing the sign to exceed the 12 foot height requirement located at 1717 West Ridgeway Avenue, legally described as follows: A parcel of land located in part of the NW 1/ of the NE Frl. 1/ and the NE 1/ of the NW Frl. 1/ all in Section 5, T88N, R13W of the 5th P.M., Black Hawk County, Iowa, as shown on Exhibit "A" attached hereto and by reference made a part hereof. Said parcel is described as follows: Commencing at the NE Corner of said Section 5; thence N89058133"W, 2162.43 ft. along the north line of the NE Frl. 4 of said Section 5; thence S0000112711W, 136.87 ft. to a point on the existing southerly right of way line of Ridgeway Ave., the Point of Beginning; thence S40049' 09"E, 56.94 ft. to a point on the northwesterly right of way line of West 4t St. ( former Primary Road No. US 63); thence S49010'49"W, 100.00 ft. along said line; thence continuing along said line S40049111"E, 15.00 ft.; thence continuing along said line S49010'49"W, 848.70 ft.; thence continuing along said line S48045'39"W, 689.81 ft. to a point on the extension of the North Line of Kingswood Add., Black Hawk County, Iowa; thence S89032152"W, 359.51 ft. along said line and the North Line of Lot 1, Kingswood Add.; thence N00000124"W, 1131.96 ft. to a point on the existing southerly right of way line of Ridgeway Ave.; thence N90000'00"E, 1064.25 ft. along said line; thence continuing along said line N89058138"E, 485.02 ft. to the Point of Beginning; containing 26.01 acres, more or less. NOTE: The north line of the NE Frl. 1/ of said Section 5 is assumed to bear N89058'33"W. Declaration of Value Filing is not required as the State of Iowa is the Grantor and exempt from such filing by Section 428A.2(6) of the Code of Iowa, all in the City of Waterloo, Black Hawk County, State of Iowa. WHEREAS, due to the insignificant nature of said minor Site Plan Amendment, the Council did not deem it necessary to hold a public hearing, and WHEREAS, it is the opinion of this Council that said minor Site Plan Amendment should be approved as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the minor Site Plan Amendment to the "R -4,C -Z" Conditional Zoning District for an addition to an existing freestanding sign causing the sign to exceed the 12 foot height requirement located at 1717 West Ridgeway Avenue, be and the same is hereby approved.
