RESOLUTION NO. 1981-506
RESOLUTION AUTHUTAZING THE SALE AND
CONVEYANCE OF CERTAIN EXCESS RIGHT-OF-WAY
TO JESSE F. PATRICIA J. LYONS FOR
S457 . 35, PLUS COSTS AND AUTHORIZING THE
li;AYOR AND CITY CLERK TO EXECUTE AND
DELIVER A DEED FOR SAE .
WHEREAS, the City of Waterloo, Iowa , is the owner of real
property in the City of Waterloo , Iowa , as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $457. 35 , plus costs , has been made by Jesse
F . 7 Patricia J. Lyons , and
WHEREAS , a public hearino was held on September 2 -3 , 1981 at
7 : 00 P.M. in the Council Chambers in City Hall , Waterloo, Iowa , as
provided by law, by the Council of the City of Waterloo, Iowa , on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa to Jesse F. P., Patricia J . Lyons , Waterloo, Iowa ,
and
WHEREAS , it is the opinion of this Council that sale and
conveyance should be made as oroposed.
NOW , THEREFORE , IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1. The folloe:inh described reel property , es fully
described in the published notice in the Waterloo Courier on -
September 15 , 191 , is not presently needed and will not he needed
in the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose , and
2. That the offer of Jesse F . P, Patricia J. Lyons to
purchase real property for the sum of four hundred fifty-seven and
35/ 100 dollars ($47 . 35 ) and costs he, and it is hereby accepted
for real property described below :
That portion of Sixty toot right-of-way of Archer
Avenue lying east of the right-of-way of Colorado
Street and west of the right-of-way line of U . S.
Highway 20, with the City ' s retention of a utility
easement above , below , and across the south twenty
(20) ft. of the above described parcel .
3. That the City of Waterloo, Iowa , convey said parcels of
real property to Jesse F . Patricia J . Lyons by Quit Claim Deed ,
the form of which is hereto attached and approved.
4. That the Mayor and City Clerk are hereby authorized to
execute and deliver deeds to Jesse F . P Patricia J. Lyons ,
S. That the original of said deed fully executed and
acknowledged having been submitted with this Resolution , the same
is hereby approved and confirmed by the Council .
6. That the City Clerk is authorized and directed to
deliver said deed of conveyance to Jesse F. e Patricia J . Lyons
upon receipt of the sun of four hundred fifty-seven and 35/100
dollars ( $457. 3F ) and costs.
Passed and adopted this 12th day of October, 1981 .
