PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date , time and place above set out. The tentative agenda for said meeting is as follows : - Resolution Fixing Date for a Meeting on the Proposition of Borrowing Not to Exceed $700 , 000 and Issuing Urban Renewal Tax Increment Revenue Notes, and Providing for Publication of Notice Thereof Such additional matters as are set forth on the addi- tional page( s) attached hereto . There were present Mayor Rooff , in the chair , and the following named Council Members : Getty , Penaluna , Roehr Wilharm, Bowers , Burton , Dowie Absent: NONE * * * * * * * -1- AHLERS. COONEY. DORWEILER, HAYNIE&SMITH. LAWYERS, DES MOINES, IOWA Wilharm _ introduced the following Resolution entitled "RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSITION OF BORROWING NOT TO EXCEED $700 ,000 AND ISSUING URBAN RENEWAL TAX INCREMENT REVENUE NOTES, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF, " and moved that the same be adopted . Bowers seconded the motion to adopt . The roll was called and the vote was, AYES: Getty , Penaluna , Roehr Wilharm, Bowers , Burton , Dowie NAYS: NONE Whereupon , the Mayor declared the resolution duly adopted as follows : Resolution No. 1981-493 RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSITION OF BORROWING NOT TO EXCEED $700 ,000 AND ISSUING URBAN RENEWAL TAX INCREMENT REVENUE NOTES, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS , it is deemed necessary and advisable that the City of Waterloo , Iowa , consider borrowing funds and issuing Urban Renewal Tax Increment Revenue Notes , in an amount not to exceed $700 ,000 , as authorized by Section 403 .9 of the Code of Iowa, for the purpose of providing funds to pay costs of carrying out the Downtown Waterloo Urban Renewal and Redevelopment Plan in accordance with the plan thereof, including without limitation the acquisition and demolition of real estate for redevelopment; and WHEREAS , neither Chapter 403 nor any other Code provision sets forth any procedural action required to be taken before said Notes may be issued , and pursuant to Section 364 .6 of the City Code of Iowa , it is determined that the procedure spe- cified in Code Section 384 .25 shall apply and it is deemed suf- ficient that the action hereinafter described be taken and the Clerk publish a notice of the proposal and of the time and place of the meeting at which the Council proposes to take -2- AHLERS, GOONEY, DORWEILER.HAYNIE&SMITH. LAWYERS, DES MOINES, IOWA action thereon and to receive oral and/or written objections from any resident or property owner of said City to such action . NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1 . That this Council meet in the Council Chambers in the City Hall , at Waterloo , Iowa, at 7 o'clock p .M. , on the 9th day of Nov. , 1981 , for the purpose of taking action on the matter of borrowing not to exceed $700 ,000 and issuing Urban Renewal Tax Increment Revenue Notes , the proceeds of which will be used to provide funds to pay costs of carrying out the Downtown Waterloo Urban Renewal and Redevelopment Plan in accordance with the plan thereof, including without limitation the acquisition and demolition of real estate for redevelopment . Section 2 . That the Clerk is hereby directed to cause at least one publication to be made of a notice of said meeting , in a legal newspaper , printed wholly in the English language , published at least once weekly, and having general circulation in said City, said publication to be not less than four clear days before the date of said public meeting . Section 3 . The notice of the proposed action shall be in substantially the following form: -3- AHLERS, GOONEY, DORWEILER, HAYNIE&SMITH, LAWYERS, DES MOINES, IOWA NOTICE OF MEETING OF THE COUNCIL OF THE CITY OF WATERLOO, IOWA, ON THE MATTER OF THE PROPOSITION OF BORROWING NOT TO EXCEED $700 ,000 AND ISSUING URBAN RENEWAL TAX INCREMENT REVENUE NOTES AND THE HEARING ON THE PROPOSAL THEREOF PUBLIC NOTICE is hereby given that the Council of the City of Waterloo , Iowa, will hold a public hearing on the 9th day of Nov , 1981 , at 7 o' clock P .M. , in the Council Chambers of the City Hall , in Waterloo , Iowa, at which meeting the Council proposes to take additional action for the borrowing of not to exceed $700 ,000 and issuing Urban Renewal Tax Increment Revenue Notes in said amount pursuant to Iowa Code Section 403 .9 , in order to provide funds to pay costs of carrying out the Downtown Waterloo Urban Renewal and Redevelopment Plan in accordance with the plan thereof, including without limitation the acquisition and demolition of real estate for redevelopment. At the above meeting the Council of said City shall receive oral or written objections from any resident or property owner of said City, to the above action . After all objections have been received and considered , the Council will at said meeting or thereafter take additional action for the making of the resolution authorizing said loan and notes as proposed or as modified or will abandon the proposal . By order of the Council said hearing and appeals therefrom shall be held in accordance with and governed by the provisions of Section 384 . 25 of the City Code of Iowa. This notice is given by order of the Council of Waterloo , Iowa, as provided by Sections 384 .25 and 364 .6 of the City Code of Iowa. Code Section 384 . 25 shall govern this meeting and action taken thereat .
