The roll was called and the vote was, AYES: Getty, William. Roehr, Dowie , Penaluna. Bowers and Burton. NAYS: None Whereupon the Mayor declared the following Resolution duly adopted: RES . NO. 1981-434 RESOLUTION ORDERING BIDS, APPROVING PLANS, SPECIFICATIONS AND FORM OF CONTRACT AND NOTICE TO BIDDERS, FIXING AMOUNT OF BID SECURITY, AND ORDERING CLERK TO PUBLISH NOTICE AND FIXING A DATE FOR RECEIVING SAME, AND FOR A PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COSTS BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the Waterloo, Iowa, F.Y. 1981 Paving Program No . 2 (Contract No . 219 ) , is hereby ordered to be advertised for - 17 - AHLERS, GOONEY, DORWEILER, HAYNIE&SMITH, LAWYERS, DES MOINES, IOWA bids for construction, pursuant to Section 384. 75, City Code of Iowa, so as to permit this Council to receive and consider bid proposals at the time of hearing on the Resolution of Necessity for the project. BE IT FURTHER RESOLVED that the detailed plans and speci- fications as prepared by the City Engineering Department, Engineer for the project, for the construction of the Waterloo , Iowa, F.Y. 1981 Paving Program No . 2 (Contract No . 219) , and the form of contract and Notice to Bidders, as approved by the Attorney, be and the same are hereby approved , subject to hearing thereon, and are hereby ordered placed on file in the office of the Clerk for public inspection. BE IT FURTHER RESOLVED, that the amount of the security to accompany each bid shall be in an amount which shall conform to the provisions of the notice to bidders hereby approved as a part of said specifications. BE IT FURTHER RESOLVED, that the Clerk be and is hereby directed to publish notice to bidders once in the Waterloo Courier , a legal newspaper, printed wholly in the English language, published at least once weekly and having general circulation in this City. Publication shall be not less than four clear days nor more than twenty days prior to September 14 , 1981, which latter date is hereby fixed as the date for receiving bids. Said bids are to be filed prior to 4: 00 o'clock p .M. , on said date, and will be opened at 7: 00 o'clock p .M. , on said date. BE IT FURTHER RESOLVED, that the Clerk be and is hereby directed to publish notice of hearing once in said newspaper , said publication to be not less than four clear days nor more than twenty days prior to the date hereinafter fixed as the date for a public hearing on the plans, specifications, form of contract and estimate of costs for said project, said hearing to be held at 7: 00 o 'clock p .M. , on Sept. 14 1981. Burger , Clerk of the City of Waterloo , Iowa, do hereby certify that on the day of , 1981 , I deposited and mailed in the United States mails , by certified mail , at Waterloo , Iowa, properly stamped and addressed a copy of the "Notice To Property Owners" for certain street improvements proposed to be constructed in said City, as more particularly described in said notice attached hereto, to each and every property owner listed on the preliminary plat and schedule of assessments referred to in said Resolution of Necessity, as shown by the latest available records in the office of the County Auditor, whose property is subject to assessment for said proposed street improvements . If property to be assessed was shown to be in the name of more than one owner at the same mailing address , a single notice was mailed , addressed to all owners at that address . With respect to property owned by the State of Iowa , and to be assessed under the preliminary plat and schedule of assessments referred to above , I further certify that on the same date set forth above , I deposited and mailed in the United States mails at the same post office , properly stamped and addressed , a copy of the aforesaid notice to each of the folowing : 1.
