A RESOLUTION AUTHORIZING THE CONDEM-
NATION OF CERTAIN EASEMENTS FOR
SANITARY SEWER PURPOSES FOR LOWDER
ROAD SANITARY SEWER PROGRAM.
WHEREAS , the City of Waterloo, Iowa , desires to undertake a
sanitary sewer program in the Lowder Road area , and the land
herein described is required for construction of said project ,
and
WHEREAS , the use of the hereinafter described real property is
necessary in conjunction with the completion of the Lowder Road
Sanitary Sewer.
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the following described parcel of real
property be acquired by condemnation in the manner provided by
law, and such other further action be taken as may be necessary to
effect the acquisition .
The legal description of the parcel to be acquired is as follows :
A permanent easement Twenty ( 20 ) feet in width over the above
described property the centerline of which is described as
follows :
Beginning at a point on the South line of the Southeast
Quarter (SE 1/4) of Section No. Twelve ( 12) , Township
Eighty-nine North ( T89N ) , Range Thirteen West (R13W) of
the Fifth Principal Meridian , Waterloo, Black Hawk County ,
Iowa that is Eight Hundred Nineteen and Five-Tenths (819. 5 )
feet East of the South Quarter (S 1/4) corner of said
Section ; Thence N 14 degrees 05 ' 53"W Four Hundred Twenty-two
and Seven tenths (422 . 7 ) Feet ; Thence N 42 degrees 35 ' 16"W
Four Hundred (400. 0) feet ; Thence N 0 degrees 20 ' 53"W to a
point on the North Line of said Section that is Four Hundred
Sixteen and Thirty-four Hundredths (4165 . 34) feet East of the
North Quarter ( N 1/4) corner of said Section twelve ( 12) ,
thereby terminating. Contains 51 , 726 Sq . Ft .
Also, a temporary easement Twenty ( 20 ) feet in even width being
adjacent to and on the easterly and Westerly side of the above
described Permanent Easement .
And also the South Twenty ( 20) feet of the North Fifty-three
( 53 ) feet of the West Four Hundred Six and Three Tenths
( 406 . 3) feet of the above described property. Contains
111 , 578 Sq . Ft .
NOTE : The South line of the Southeast Quarter of Section twelve
is assumed to bear N88 degrees 37 ' 13 "W.
