A RESOLUTION GRANTING PERMISSION TO GARY fl.
ERDES, AND AUTHORIZING CONSTRUCTION 07 ONE
(1) TEAPORARY CONCRETE DRIVEWAY
IRRESPECTIVE OF A LATER OFFICIAL GRADE.
hE IT RESOLVED BY THE COUNCIL OP THE CITY OF WATERLOO, IOWA:
That,
WHEREAS, Gary Zrbes has made written application to the
City Council asking that he be authorized and permitted to
construct one (1 ) temporary concrete driveway without respect to a
pereaaneht sidewalk .grade when and if the same may be subsequently
set on Dyrnbrae Replat, Waterloo, all Lot 50 exc. 10 ft. known
as 224 Byrnbrae Street; and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be :'ranted, now,
therefore,
BE IT FURTHER fT,30LVED that permission is hereby ranted to
Gary J . Erbes to construct one ( 1 ) temporary concrete driveway in
accordance with the existing contour of the abutting land with the
subjective underatandire3 and agreement between the City of
aterloo, Iowa, and the said Gary Erbes that, should at a later
date a permanent formal grade be established for sidewalk purposes
or otherwise, that the said Gary Erbes will immediately
thereafter, and at his own expense, reove all or whatever portion
of temporary concrete driveway he may have constructed, and
rebuild or reconstruct the same in accordance with the pereeanent
trade as may hereafter be set and established, the work to be done
under the supervision of the City Engineer.
BE If FURTHER RESOLVED, that the City Clerk is authorized
and directed to forward a certified copy of this resolution to the
lack ieawk County Recorder for recording and the IJlace i' awk County
Auditor for filing in order that this said action may become a
matter of official County Record.
