RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF
SID LEDERMAN , TO REZONE FROM "A-1 "
AGRICULTURAL DISTRICT TO "C-1 " COMMERCIAL
DISTRICT A PARCEL OF LAND GENERALLY
LOCATED SOUTH OF U . S. HIGHWAY 218 AND
EAST OF DYSART ROAD , AS JULY 13 , 1981 , AT
7 : 00 P .M. IN THE COUNCIL CHAMBERS IN CITY
HALL AND INSTRUCTING CLERK TO PUBLISH
NOTICE OF HEARING .
WHEREAS , the Council of the City of Waterloo , Iowa , shall meet in
the Council Chambers in the City Hall in the City of Waterloo ,
Iowa at 7 : 00 P. M . on the 13th day of July , 1981 for the purpose of
considering and acting upon an application of Sid Lederman to
rezone from "A- 1 " Agricultural District to "C- 1 " Commercial
District a parcel of land generally located south of U . S . Highway
218 and east of Dysart Road and legally described as follows :
A triangular one acre tract lying in the North corner
of that part of Section No. Eighteen ( 18) , Township No .
Eighty-eight (88) North , Range No . Twelve ( 12 ) West of
the Fifth ( 5th ) Principal Meridian , Black Hawk County ,
Iowa , lying West of U . S . Highway #218, the South line
of said triangular one acre tract running directly East
and West , and said one acre tract being also described
as follows :
Commencing at the point of intersection of the East
line of the public road lying along the West line of
said Section with the Southwesterly line of U . S .
Highway #218, thence South along the East line of said
Road a distance of Three Hundred Forty-seven and
twenty-five hundredths ( 347 . 25 ) feet ; thence East a
distance of Two Hundred Fifty-one (251 ) feet to the
Southwesterly line of U . S . Highway #218 ; thence
Northwesterly along the Southwesterly line of said
Highway a distance of Four hundred Twenty-eight and
six-tenths (428 . 6) feet to the place of beginning.
Except from the above described tract that part thereof
lying within the following described boundaries :
Commencing at the Northwest Corner of said Section ;
thence East along the North line of said Section a
distance of Nine and nine-tenths ( 9 . 9 ) feet ; thence
Southeasterly at an angle of Fifty-four ( 54) degrees
Thirty-five and one-half ( 35 1 /2) minutes a distance of
Thirty-nine and five-tenths ( 39 . 5 ) feet which is the
point of beginning of the tract herein excepted ; thence
South along a line which is Thirty-three (33 ) feet East
of and parallel with the West line of said Section a
distance of Two Hundred Four and one-tenth ( 204 . 1 )
feet ; thence East at right angles a distance of
Fifty-one and forty-five hundredths ( 51 . 45 ) feet ;
thence North at right angles a distance of Thirty-five
and five-hundredths ( 35 . 05 ) feet ; thence Northeasterly
at an angle on One Hundred Thirty-four ( 134) degrees
six (6) minutes a distance of forty and thirty-five
hundredths (40 . 35 ) feet ; thence Northwesterly at an
angle of Ninety-eight ( 98) degrees Twenty-six (26)
minutes a distance of Fifty-seven and six-tenths ( 57 . 6 )
feet ; thence Northeasterly at right angles a distance
of Seventeen ( 17 ) feet ; thence Northwesterly at right
angles a distance of One Hundred Four ( 104) feet to the
place of beginning.
Also except that part thereof conveyed to the State of
Iowa for road purposes by Warranty Deed filed October
9 , 1952 , and recorded in Land Deed Record 111 at Page
567 of the records of Black Hawk County , Iowa .
