A RESOLUTION GRANTING PERMISSION TO LOWELL H .
YEARLING , AND AUTHORIZING CONSTRUCTION OF ONE ( 1 )
TEMPORARY ASPHALT DRIVEWAY IRRESPECTIVE OF A LATER
OFFICIAL GRADE .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO , IOWA :
That,
WHEREAS , Lowell H . Yearling has made written application to
the City Council asking that he be authorized and permitted to
construct one ( 1 ) temporary asphalt driveway without respect to a
permanent sidewalk grade when and if the same may be subsequently
set on Zelmar Addition , Waterloo , Lot 17 known as 1223 Maxine
Avenue ; and
WHEREAS , it is the sense of the Council of the City of
Waterloo, Iowa , that said request should be granted, now,
therefore,
BE IT FURTHER RESOLVED that permission is hereby granted to
Lowell H . Yearling to construct one ( 1 ) temporary asphalt driveway
in accordance with the existing contour of the abutting land with
the subjective understanding and agreement between the City of
Waterloo , Iowa , and the said Lowell H . Yearling that , should at a
later date a permanent formal grade be established for sidewalk
purposes or otherwise , that the said Lowell H . Yearling will
immediately thereafter, and at his own expense, remove all or
whatever portion of temporary asphalt driveway he may have
constructed, and rebuild or reconstruct the same in accordance
with the permanent grade as may hereafter be set and established ,
the work to be done under the supervision of the City Engineer.
BE IT FURTHER RESOLVED , that the City Clerk is authorized
and directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
Passed and adopted this 22th day of June , 1981 .

RF IT FURTHER RESOLVED that permission is hereby nranted to
Lowell H . Yearling to construct one ( 1 ) teNnerary asphalt driveway
in accordance with the existing contour of the abutting land with
the subjective understanding and agreelent between the City of
Waterloo, Iowa , and the said Lowell H . Yearling that , should at a
later date a nerrdanent formal grade he established for sidewalk
purposes or otherwise, that the said Lowell H . Yearlinn will
iiiimediately thereafter, and at his own expense, reqove all or
whatever portion of temporary asphalt driveway he nay have
constructed , and rebuild or reconstruct the same in accordance
with the permanent grade as may hereafter he set and established ,
the work to be done under the supervision of the City Engineer.
IT FURTHER RESOLVED , that the City Clerk is authorized
and directed to forward a certified cony of this resolution to the
=flack Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County record .
Passed and acinpted this 22th day of June , 1931 .
