A RESOLUTION AUTHORIZING AND APPROVING THE EXECUTION OF AN EASEMENT AGREEMENT BY
AND BETWEEN THE CITY OF WATERLOO, IOWA AND THE ILLINOIS CENTRAL GULF RAILROAD
WHEREAS, the City of Waterloo, Iowa has undertaken the Local Flood Protection
Project, and
WHEREAS, it is necessary to obtain a Permanent Easement on property of the
Illinois Central Gulf Railroad, hereinafter described, in order to carry out said
Flood Control Project
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa that the attached Easement Agreement with the Illinois Central Gulf Railroad
for property hereinafter described, all of which is situated in the City of Waterloo,
Iowa is accepted and approved and the Mayor and City Clerk are authorized and
directed to execute the same in behalf of the City and to execute all instruments
necessary to consummate the Agreement with the Railroad; and be it further resolved
the City of Waterloo is directed to pay $1,238.00 for the easements from Flood
Control funds.

thirty ( 30 ) and thirty-one ( 31 ) , township eighty-nine (89)
north , range twelve ( 12 ) , west of the fifth principal
meridian , said strip of land being fifteen ( 15 ) feet in width
on each side of the center line thereof ; said center line
intersects the southeast line of said lot twenty-one ( 21 ) at
a point five hundred thirty-two ( 532 ) feet southerly from the
south line of Lafayette Street , and runs thence northwesterly
along a five ( 5) degree curve convex towards the north three
hundred fifteen ( 315 ) feet to a point in the easterly line of
lot ten ( 10) , block two ( 2 ) , Kahler ' s addition , thirty-six
( 36 ) feet northerly from the southeast corner of said lot ten

southerly from the south line of Lafayette Street measured
along said southeast line , and runs thence on a five ( 5)
degree curve to the right, twenty-four ( 24 ) feet ; thence
south sixty-one (61 ) degrees fifty-six (56 ) minutes east four
hundred thirty-seven and five tenths ( 437 . 5 ) feet ; thence on
a seven ( 7 ) degree thirty ( 30 ) minute curve to the left four
hundred eleven and five tenths ( 411 . 5 ) feet ; thence north
eighty-seven degrees twelve minutes east , seven hundred
twenty ( 720 ) feet to the southwest line of Lafayette Street.

All that part of the following parcels of land which is at or below
elevation 838. 1 (Mean Sea Level Datum )

A strip of land one hundred and five tenths ( 100 . 5 ) feet
wide , extending over and across the Grantor ' s twenty-two (22 )
acre tract . Said tract is located in sections thirty ( 30)
and thirty-one ( 31 ) , township eighty-nine (89 ) , north , range
twelve ( 12 ) , west of the fifth ( 5th ) principal meridian , and
extends from Lafayette Street on the north to Cedar River on
the south , and is bounded on the east and west by Cotton ' s
addition to the City of Waterloo . The strip hereby conveyed
