RESOLUTION INSTITUTING PROCEEDINGS TO TAKE
ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO
EXCEED $3 , 970, 000. 00 GENERAL OBLIGATION BONDS ( FOR
ESSENTIAL CORPORATE PURPOSES ) .
WHEREAS, pursuant to notice
published as required by law ,
this Council has held a
public meeting and hearing upon the
proposal to institute proceedings for the issuance of not to
exceed $3 , 970 , 000 . 00 General Obligation Bonds for the essential
corporate purposes of paying costs of ( 1 ) constructing certain
permanent street improvement projects in said City , generall
described as (a ) Annual Street Pavingy
Hackett Road (Advance Acquisition (Klingaman Area ) , (b)
)
San Marnan Frontage Road , (e) 6th Year )Block lGrant aPaving , ( f) d )
Fletcher and Ansborough Railroad Crossing Repairs , and
Downtown UDAG Street Improvements TIF (g )
'
improvement projects to the storm sewer systemooftsaidiCitcertainy ,
generally described as (a ) Castle Hill , ( b ) Ackermant , (c )
Columbus , (d ) Rachael , and (e) Carriage Hill ; ( 3) 18th Street
Bridge Repair Project ; (4) Traffic Signal Replacement Project ; ( 5 )
Airport Runway and Apron Improvements Project ; ( 6) Riverview
By-Pass Channel Project ; ( 7 ) Dawson Sidewalk Repair Project ; (8 )
Castle Hill Lawsuit Judgment ; and (9 ) Lowder Road Sanitary Sewer
Project , and has considered the extent of objections received from
residents or property owners as to said proposed issuance of
bonds ; and
NOW , THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA :
Section 1 . That this Council does hereby institute
proceedings and take additional action for the authorization
and issuance in the manner required by law of not to exceed
$3 , 970 , 000 . 00 General Obligation Bonds for the foregoing essential
corporate purposes .
Section 2. The Clerk is authorized and directed to proceed
on behalf of the City with the sale of said bonds , to select a
date for the sale thereof , to cause to be prepared such notice and
sale information as may appear appropriate , to publish and
distribute the same on behalf of the City and this Council and
otherwise to take all action necessary to permit the sale of said
bonds on a basis favorable to the City and acceptable to the
Council .

RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF CERTAIN EXCESS RIGHT-OF-WAY
TO CBS REAL ESTATE COMPANY OF BLACK HAWK
COUNTY FOR $1 , 527 . 10, PLUS COSTS , AND
EMORY L. & ARNELDA PETERMAN & FREDRICK A.
& MARIE E . HAES FOR $1 , 527 . 10 , PLUS COSTS ,
AND AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AND DELIVER A DEED FOR SAME .
WHEREAS , the City of Waterloo, Iowa , is the owner of real
property in the City of Waterloo , Iowa , as described below, and
WHEREAS , an offer to purchase said certain parcel of real
property in the sum of $1 , 527 . 10 , plus costs , has been made by
CBS Real Estate Company of Black Hawk County and Emory L . &
Arnelda Peterman & Fredrick A. & Marie E . Haes , and
WHEREAS , a public hearing was held on June 1 , 1981 at 7 : 00
P . M . in the Council Chambers in City Hall , Waterloo , Iowa , as
provided by law, by the Council of the City of Waterloo, Iowa , on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa , to CBS Real Estate Company of Black Hawk County
and Emory L . & Arnelda Peterman and Fredrick A. & Marie E . Haes ,
Waterloo, Iowa and ,
WHEREAS , it is the opinion of this Council that sale and
conveyance should be made as proposed .
NOW , THEREFORE , IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property , as fully
described in the published notice in the Waterloo Courier on May
15 , 1981 , is not presently needed and will not be needed in the
foreseeable future for municipal purposes and its ownership is
serving no municipal purpose , and
2 . That the offer of CBS Real Estate Company of Black Hawk
County to purchase real property for the sum of one thousand five
hundred twenty-seven and ten/100 dollars ( $1 , 527 . 10) , and costs ,
be , and it is hereby accepted for real property described below:
The east 1/2 of the following described property :
Starlite Boulevard from the north right-of-way
line of Crossway Drive to the south right-of-way
line of U . S. Highway 218 as now established.
With the City ' s retention of an easement over,
under and above the following described property :
All that part of the following described easement
lying easterly of the centerline of Starlite Boule-
vard as platted in Cedarloo Park located in Black
Hawk County , Waterloo, Iowa , west of the 5th P .M.
Beginning at the southwest corner of University
Avenue and Starlite Boulevard as now established ;
thence southeasterly along a line 55 feet from and
parallel with the centerline of University Avenue
as now established to the easterly line of Starlite
Boulevard ; thence south along the east line of Star-
lite Boulevard a distance of 35 feet ; thence north-
westerly parallel with the centerline of University
Avenue to a point 10 feet normal distant easterly of
the centerline of Starlite Boulevard ; thence southerly
along a line 10 feet easterly of and parallel with the
centerline of Starlite Boulevard to the north R-O-W
line of Crossway Drive ; thence northwesterly along the

($1 , 527 . 10) , and costs , be, and it is hereby accepted for real
property described below :

4 . That the City of Waterloo , Iowa , convey said parcels of
real property to CBS Real Estate Company of Black Hawk County and
Emory L . & Arnelda Peterman and Fredrick A. & Marie E . Haes by
Quit Claim Deed, the form of which is hereto attached and
approved.
5 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deeds to CBS Real Estate Company of Black Hawk
County and Emory L . & Arnelda Peterman and Fredrick A. & Marie E .
Haes .
6 . That the original of said deeds fully executed and
acknowledged having been submitted with this Resolution , the same
is hereby approved and confirmed by the Council .
7 . That the City Clerk is authorized and directed to
deliver said deeds of conveyance to CBS Real Estate Company of
Black Hawk County upon receipt of the sum of one thousand five
hundred twenty-seven and 10/100 dollars ($1 , 527 . 10 ) , and costs ,
and to Emory L . & Arnelda Peterman and Fredrick A. & Marie E . Haes
upon receipt of the sum of one thousand five hundred twenty-seven
and 10/100 dollars ($1 , 527 . 10) , and costs .
