HomeMy WebLinkAbout1981-206-05.04.1981 RESOLUTION N0 . 1981-206 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CERTAIN EXCESS PROPERTY TO JOE MINARD CONSTRUCTION COMPANY AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME . WHEREAS , the City of Waterloo, Iowa , is the owner of real property in the City of Waterloo, Iowa , as described below, and WHEREAS , an offer to purchase said certain parcel of real property in the sum of $193 , 160 .00, plus costs , has been made by Joe Minard Construction Co . , and WHEREAS , a public hearing was held on April 27 , 1981 at 7 : 00 P .M. in the Council Chambers in City Hall , Waterloo, Iowa , as provided by law , by the Council of the City of Waterloo , Iowa , on the proposal to sell and convey premises owned by the City of Waterloo, Iowa to Joe Minard Construction Co . , Waterloo , Iowa , and WHEREAS , it is the opinion of this Council that sale and conveyance should be made as proposed. NOW , THEREFORE , IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property , as fully described in the published notice in the Waterloo Courier on April 10 , 1981 , is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose , and 2 . That the offer of Joe Minard Construction Co. to purchase real property for the sum of one hundred ninety-three thousand one hundred sixty dollars ($193 , 160. 00) and costs be, and it is hereby accepted for real property described below : Parcel A The West 1/2 of the Northwest 1/4 of the Northeast 1/4 of Section 29 , Township 89 North , Range 13 West of the 5th P .M. in the City of Waterloo, Black Hawk County , Iowa and excepting all legal streets and highways . Parcel B The East 1/2 of the Northeast 1/4 of the Northwest 1/4 of Section 29 , Township 89 North , Range 13 West of the 5th P .M. in the City of Cedar Falls , Black Hawk County , Iowa and excepting all legal streets and highways . Parcel C The East 300 feet of the Southeast 1/4 of the Northwest 1/4 of Section 29 , Township 89 North , Range 13 West of the 5th P .M. in the City of Cedar Falls , Black Hawk County , except the Easterly 91 feet of the Southerly 413 feet thereof, and excepting all legal streets and highways . 3 . That the City of Waterloo , Iowa , convey said parcels of real property to Joe Minard Construction Co. by Quit Claim Deed , the form of which is hereto attached and approved. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deeds to Joe Minard Construction Co . 5 . That the original of said deed fully executed and acknowledged having been submitted with this Resolution , the same is hereby approved and confirmed by the Council . BOOK 240 PAGE 4Oa -2- 6 . That the City Clerk is authorized and directed to deliver said deed of conveyance to Joe flinard Construction Co. upon receipt of the sum of one hundred ninety-three thousand one hundred sixty dollars (S193, 160. 00) and costs .
