HomeMy WebLinkAbout1981-192-05.27.1981 RESOLUTION NO. / 9 g / - / 7 A RESOLUTION ACCEPTING AND APPROVING CERTAIN OFFERS TO RELEASE RAILROAD SERVICE FOR A RAILROAD SPUR LINE AND ACCEPTING AND APPROVING AGREEMENT WHEREAS, the City of Waterloo, Iowa has determined it necessary to abandon and remove a certain Chicago and Northwestern Transportation Company spur line in order to carry out the Waterloo Local Flood Control Project. And WHEREAS, it is necessary for all property owners affected by the abandonment to execute Railroad Service Releases, and such owners shall be compensated for damages. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa that the offers of the Owners to Release Railroad Service on the following described property, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute all instruments necessary to consummate the Agreement with the owners thereof, and the City of Waterloo is directed to pay for the damages from Flood Control Funds. The subject property owners are: Tenant Description W. H. Hartman Company See attached Legal and Agreement (Waterloo Courier) Passed and adopted this -7 day ofApr-L ! , 1981 u Mayor ATTEST: Cit Cl t SPUR TRACK RELEASE AGREEMENT WHEREAS, the City of Waterloo, in connection with its local Flood Control Project, has determined that it is necessary to discontinue service of and remove the spur track of the Chicago and Northwestern Transportation Company, located along the West side of the Cedar River between Commercial Street, West 6th Street, and West 10th Street. In order to effect removal of said spur track, the City of Waterloo has filed an application with the Transportation-Regulation Board of the Iowa Department of Transportation. In consideration of the payment of $9, 900. 00 from the City of Waterloo, Iowa, the undersigned does hereby consent to the removal of the spur track as described above and the discontinuing of service of said spur track, and hereby releases, acquits and discharges the City of Waterloo, Iowa, from any and all claims and liability whatsoever as a result of the abandonment of said railroad service.
