TUTTLE , Arm AUTHORIZING CONSTRUCTION OF ONE ( I )
TEMPORARY ASPHALT r$RIVEWAY IRRESPECTIVE OF .A LATER
OFFICIAL GRADE .
PE IT RESOLVED BY THE COUNCIL CF THE CITY OF WATERLOO, IOWA :
That ,
WHEREAS , Earl J . Tuttle has P,ade written annlication to the
City Council asking that he he authorized and permitted to
construct one ( 1 ) temporary asphalt driveway without respect to a
permanent sidewalk nradp when and if the same may he subsequently
set on Clyde Miller Heights , Waterloo, Lot 7 , Block 4 known as
236 Auburn.
UHEREAS , it is the sense of the Council of the City of
Waterloo, Iowa , that said request should he granted , now,
therefore ,
BE ir FURTHER RESOLVED that permission is hereby granted to
Earl J. futtle to construct one ( 1 ) temporary asphalt driveway in
accordance with the existing contour of tote abutting land with the
subjective understanding and anreement between the City of
4aterloo , Iowa, and the said Earl J . Tuttle that , should at a
later date a nermanent formal grade be established for sidewalk
purposes or otherwise, that the said Earl J . Tuttle will
immediately tnereafter, and at his own expense, remove all or
whatever portion of temporary asohalt driveway he may have
constructed, and rebuild or reconstruct the same in accordance
with the permanent grade as may hereafter be set and established ,
the work to he done under the supervision of the City Enoineer.
PE IT FURTHER REsoLvFn , that the City Clerk is authorized
and directed to forward a certified copy of this resolution to the
Black Hawk County ' ecorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County kecor-!.
