A RESOLUTION AUTHORIZING THE CONDEMNATION OF CERTAIN REAL
PROPERTY FOR THE FLOOD CONTROL PROJECT.
WHEREAS, the City of Waterloo, Iowa, has undertaken a Flood Control
Project, and the parcel of land hereinafter described has been appraised
and an offer made to all parties which have an interest in said property
in the amount of the appraised value; that said offers have been refused;
that funds are available with which to pay for and acquire said parcel
from Flood Control Funds.
WHEREAS, the acquisition of the hereinafter described real property
is necessary in conjunction with the completion of the Flood Control Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Waterloo, Iowa, that the following described parcel of real property be
acquired by condemnation in the manner provided by law, and such other
further action be taken as may be necessary to effect the acquisition.
The legal description of the parcel to be acquired is as follows:

All that portion of the following described easement (dated
February 27, 1959, and filed for record February 28, 1959,
in Book 116 of Miscellaneous Records at Page 589 in the office
of the Recorder of Black Hawk County, Iowa) lying within Lots
46 and 47 in Fractional Block 10, Original Plat on the West
Side of the Cedar River in the City of Waterloo and within
vacated West 9th Street adjoining said Block:
A parcel of land across vacated West Ninth Street, Fractional
Block Number 9 and Fractional Block Number 10, in the Original
Plat on the West Side of the Cedar River, in the City of Waterloo,
Black Hawk County, Iowa, 17 feet in width, said parcel being
bounded by parallel lines 8.5 feet distant, either side of a
center line more particularly described as follows: Commencing
at the intersection of the North line of Commercial Street and the
East line of Eighth Street; thence Northeasterly along the East
line of Eighth Street a distance of 369.8 feet to a point in the
centerline of the Chicago Great Western Railway Company's track
which is the place of beginning; thence deflecting to the right
at an angle of 104 degrees 50 minutes to become tangent to a curve
to the left having a radius of 311.06 feet, and Southeasterly along
said curve a distance of 116. 1 feet to a point; thence Southeasterly
and tangent to the last described course a distance of 554.6 feet
and thereby terminating.
The last mentioned course when extended Southeasterly intersects
the West line of Tenth Street at a point 360.3 feet from the
North line of Commercial Street measured along said West line of
Tenth Street.
