A RESOLUTION AMENDING RESOLUTION NO. 1981-29, APPROVING AND GRANTING NATIONAL
BY-PRODUCTS, INC. A PERPETUAL RIGHT AND EASEMENT
WHEREAS , A Resolution Approving a certain Offer to sell real property
from National By-Products, Inc. to the City and approving certain Deeds,
was passed and adopted on January 19, 1981, Resolution No. 1981-29; and
WHEREAS, said Resolution approved acquisition of land for the purpose
of carrying out the Local Flood Control Project; and
WHEREAS, the legal description inadvertently omitted a certain term
and condition reserving the grantor, National By-Products, Inc° a perpetual
right and easement to turn and park motor vehicles on all said property in
Block 6, Eighmey's Outlots, except on the flood levee and flood wall situated
along the Cedar River.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL of the City of Waterloo,
Iowa, that the following clause be added to the legal description contained
in Exhibit A of Resolution No. 1981-29,
"The City of Waterloo conveys to National By-Products, Inc. a perpetual
right and easement for turning and parking of motor vehicles on all said
property located in Block 6, Eighmey's Addition, except on the flood levee
and wall situated thereon along the Cedar River."
