RESOLUTION NO. 2023-169
RESOLUTION ESTABLISHING A FEE FOR RETURNED
CHECKS AND CREATING A GUARANTEED PAYMENT
ONLY POLICY FOR INDIVIDUALS OR BUSINESSES WHO
HAVE PASSED TWO RETURNED CHECK IN A TWELVE
MONTH PERIOD TO THE CITY OF WATERLOO.
WHEREAS, the City of Waterloo receives payments in the form of cash, checks, money
orders, cashier's checks, certified checks, account debit, credit cards, and debit cards for various
city services, from organizations and individuals; and
WHEREAS, the City of Waterloo currently receives these payments in person, in the
drop box, through the mail, ACH, and online; and
WHEREAS, the City of Waterloo occasionally has payments returned for insufficient
funds, account closed, no account found, fraud, stop payment, and other reasons; and
WHEREAS, Section 554.3512 of the Code of Iowa states, "The holder of a dishonored
check, draft or order may assess against the maker of that check, draft or order a surcharge not to
exceed thirty ($30.00) dollars".
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA, to set the following Payment Policy:
1. A fee of thirty ($30.00) is hereby established for servicing all returned payments
received by the City of Waterloo.
2. The City of Waterloo will only accept guaranteed payment (cash, certified check,
cashier's check, or money order) from any individual or business who has had a payment
returned to the City of Waterloo more than one (1) time in any given period of twelve (12)
months.
3. The restriction of guaranteed payment shall last for one (1) year from the most recent
returned payment date.
4. Notice of this Payment Policy shall be posted prominently at the City of Waterloo
City Hall customer service counters.
PASSED AND ADOPTED this 20th day of March, 2023.
