RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND
NOTICE TO BE GIVEN ON VACATION, SALE,AND CONVEYANCE
OF A PORTION OF WEST FOURTH STREET RIGHT-OF-WAY
NEAR THE FUTURE HOTEL SITE AS FEBRUARY 23 , 1981 AT
7 : 00 P.M. IN COUNCIL CHAMBERS OF THE CITY HALL AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE
OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA
AS FOLLOWS :
Section 1-That the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa at 7 : 00 P .M. ,on the 23rd day of February 1981, for
the purpose of considering and acting upon a proposal to vacate,
sell ,and convey a portion of West Fourth\ Street right-of-way
near the future site of the hotel requested by Continental
Investment Group ,owned by the City of Waterloo , Iowa, described
as follows :
All that part of the Right-Of-Way of West Fourth Street
lying adjacent to Lot 5 , Block 8, original plat on the West
Side of the Cedar River,Waterloo ,Black Hawk County, Iowa
lying within the following described boundary :
Beginning at the North corner of said Lot 5 ; thence
Southwesterly along the Northwesterly line of said
Lot 5 to the West corner of said Lot 5 ; thence North-
westerly along an extension of the Southwesterly
line of Said Lot 5 a distance of 34. 13 feet to a
point which is 40 feet normally distant Southeasterly
from the centerline of the existing West Fourth
Street Paving;thence deflecting to the right in a
Northeasterly direction at an angle of 75° 13 ' 30"
along a line which is parallel with the centerline of
the West Fourth Street Paving a distance of 47 . 54
feet ; thence Northwesterly normal to the Northwesterly
line of said Lot 5 a distance of 11 . 11 feet; thence
Northeasterly parallel with the Northwesterly line
of said Lot 5 a distance of 18 . 00 feet ; thence South-
easterly normal to the Northwesterly line of said
Lot 5 a distance of 6 . 38 feet to a point which is
40 feet normally distant Southeasterly from the center-
line of the West Fourth Street Paving ; thence de-
flecting to the left in a Northeasterly direction at
an angle of 104° 43 ' 50" along a line which is
parallel with said West Fourth Street centerline a
distance of 6 . 18 feet ; thence Northeasterly along a
curve concave Southeasterly, tangent to the last de-
scribed line and having a radius of 876 . 73 feet a
distance of 73 . 34 feet (Arc Length) to a point on the
Northwesterly extension of Northeasterly line of
said Lot 5 ; thence Southeasterly a distance of 68 . 17
feet to the point of beginning.
containing 7 . 540 . 08 S .F.
with the City' s retention of an easement for air rights
for an aerial skywalk over the following described parcel :
Easement for the construction and maintenance of an
overhead walkway over West Fourth Street connecting
the Conway Civic Center with the hotel proposed to
be constructed at the South corner of the intersection
of West Fourth Street and Commercial Street.The
walkway enclosure will be constructed 12 feet high
by 10 feet wide with a minimum underside clearance
of 16 feet over the centerline of the existing West
Fourth Street Paving.
The centerline of the proposed walkway is described
as follows :
