RESOLUTION APPROVING RELEASE OF REAL ESTATE
MORTGAGE WITH KENNETH R. WYANT FOR 109 E.
EAGLE ROAD, FORMERLY KNOWN AS 19 E. EAGLE
ROAD, FOR PAYMENT OF PROMISSORY NOTE IN
CONJUNCTION WITH THE KIMBALL SOUTH RURAL
WATER MAIN PROJECT AND DIRECTING EXECUTION OF
SAID RELEASE OF REAL ESTATE MORTGAGE BY
MAYOR.
WHEREAS, Kenneth R. Wyant has paid the Waterloo Water Works
the remaining balance of the Promissory Note and Mortgage for 109
E. Eagle Road, formerly known as 19 E. Eagle Road, in conjunction
with the Kimball South Rural Water Main Project for the following
described property:
Commencing at the Southwest corner of the Southwest
Quarter (SWY44) of Section No. Fifteen (15) Township No.
Eighty -Seven North (87 N), Range No. Thirteen (13) West
of the Fifth Principal Meridian, Black Hawk County,
Iowa; thence .running East on Section line twenty (20)
rods; thence North Eight (8) rods; thence West twenty
(20) rods; thence South on Section line eight (8) rods
to place of beginning, all in the City of Waterloo,
Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Release of Real Estate Mortgage dated
January 11, 2010, for payment of Promissory Note in conjunction
with the Kimball South Rural Water Main Project, by and between
Kenneth R. Wyant and the City of Waterloo, Iowa, be and the same
is hereby approved, and the Mayor and City Clerk authorized to
execute the same in behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 11th day of January, 2010.
