HomeMy WebLinkAbout27032 (2) RESOLUTION NO. 2 -7 .f.) 3 2 RESOLUTION AUTHORIZING THE CONVEYANCE OF THAT PART OF POPLAR STREET LOCATED WEST OF THE WESTERLY RIGHT-OF-WAY LINE OF RIVERSIDE DRIVE, AS PUBLISHED IN THE WATERLOO COURIER ON MAY 16, 1980, TO JOYCE M. GOSS AND PAUL L. & DONNA M. HAMILTON, AND DIRECTING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AND DELIVER A DEED FOR SAID PROPERTY. WHEREAS, the City of Waterloo, Iowa, is the owner of real property, in the City of Waterloo, Iowa, as described below, and WHEREAS, the City of Waterloo, Iowa is desirous to convey said certain parcel of real property to Joyce M. Goss and Paul L. & Donna M. Hamilton, in an exchange of deeds, and WHEREAS, a public hearing was held on June 2, 1980, at 7 :00 p.m. in the Council Chambers in City Hall , Waterloo, Iowa, as provided by law, and by the Council of the City of Waterloo, Iowa, on the proposal to convey premises owned by the City of Waterloo, Iowa, to Joyce M. Goss and Paul L. & Donna M. Hamilton, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that conveyance should be made as proposed. Now, therefore, it is hereby resolved by the Council of the City of Waterloo, Iowa, as follows: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier, on May 16, 1980, is not presently needed and will not be needed in the forseeable future for municipal purposes and its ownership is serving no municipal purposes: All that part of Poplar Street located west of the westerly right-of-way line of Riverside Drive, Cedar River Park in the City of Waterloo, Black Hawk County, Iowa. 2. That the City of Waterloo, Iowa, convey the following parcel of real property to Joyce M. Goss by Quit Claim Deed, the form of which is hereto attached and approved: A tract of land being a part of Poplar Street extended to the river in Division "A," Cedar River Park, Waterloo, Iowa more particularly described as follows; Beginning at the Southeast corner of Lot No. Four (4) , Block No. Six (6) in said Division "A," Cedar River Park; thence South Twenty Five Degrees Thirty Four Minutes West (S 25°34'W) along the Northwesterly line of Riverside Drive a distance of Sixteen and Sixty Three Hundredths (16.63) feet to the center of said Poplar Street; thence North Eighty Five Degrees Twenty Four Minutes West (N85°24'W) a distance of One Hundred Ninety Two and Thirty Six Hundredths (192.36) feet to a point in the North line of Poplar Street extended; thence due East along the North line to Poplar Street a distance of One Hundred Ninety Eight and Nine Tenths (198.9' ) feet to the point of beginning. 3. Also that the City of Waterloo, Iowa, convey the following parcel of real property to Paul L. & Donna M. Hamilton, by Quit Claim Deed, the form of which is hereto attached and approved: All of Poplar Street lying westerly of the westerly line of Riverside Drive, except: A tract of land being a part of Poplar Street extended to the river in Division "A," Cedar River Park, Waterloo, Iowa more particularly described as follows: Beginning at the Southeast corner of Lot No. Four (4) , Block No. Six (6) in said Division "A," Cedar River Park; thence South Twenty Five Degrees Thirty Four Minutes West (S25°34'W) along the Northwesterly line of Riverside Drive a distance of Sixteen and Sixty Three Hundredths (16.63) feet to the center of said Poplar Street; thence North Eighty Five Degrees Twenty Four Minutes West (N85°24'W) a distance of One Hundred -2- Ninety Two and Thirty Six Hundredths (192.36) feet to a point in the North line of Poplar Street extended; thence due East along the North line of Poplar Street a distance of One Hundred Ninety Eight and Nine Tenths (198.9' ) feet to the point of beginning. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver said deeds to Joyce M. Goss and Paul L. & Donna M. Hamilton, 5. That the original of said deed fully executed and acknowledged having been submitted with this Resolution, the same is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deeds of conveyance to Joyce M. Goss and Paul L. & Donna M.
