RESOLUTION AUTHORIZING THE CONVEYANCE OF A CERTAIN PARCEL
TO HILL TOWER ESTATES,INCOIN EXCHANGE FOR THE CONVEYANCE
OF A PARCEL TO THE CITY OF WATERLOO.
WHEREAS,the City of Waterloo,Iowa, is the owner of real property
in the City of Waterloo,Iowa, as described below,and
WHEREAS , Hill Tower Estates,Inc . is the owner of real property
in the City of Waterloo,Iowa,is described below,and
WHEREAS, the City of Waterloo desires to undertake the F.Y .
1981 Carriage Hill Retention Basin,Contract No. 210 and
WHEREAS , said project requires utilization of property cur-
tently owned by Hill Tower Estates ,Inc . and
Whereas, a public hearing was held on September 22 , 1980,at 7 :00
P.M. in the City /11611 Council Chambers in City Hall ,Waterloo,Iowa
as provided by law,by the Council of the City of Waterloo, Iowa,on
the proposal to dispose of property,described below, in exchange for
property owned by Hill Tower Estates ,Inc . ,and
WHEREAS, it is the opinion of this Council of the City of Waterloo,
Iowa that said disposition and conveyance should be made as proposed.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY
OF WATERLOO,IOWA AS FOLLOWS:
1. The following described real property as fully described in
the published notice in the Waterloo Courier on September 5, 1980,is
not presently needed and will not be needed in the foreseeable future
for municipal purposes and its ownership is serving no Municipal
purpose,and
Part of the NE quarter of the SE quarter of the SW quarter
Sec 21 T 89 R 13 beginninyg at the point of intersection of
the NELY line of U.S . Highway 218 as now established with a
line 30 feet W. of and parallel with the W line of the E half
NE quarter SE quarter SW quarter said Section;thence N along
said parallel line 250 feet ;thence SELY parallel with the
centerline of U.S . Highway 218 to the West line of the E
half NE quarter SE quarter V quarter; tnence South along said
line 250 feet to the NELY R-O-W of Highway 218;thence NWLY
33 .97 feet along saint R-O-W to point of beginning
2 . That the City of Waterloo,Iowa,convey said parcel of real
property to Hill Tower Estates ,Inc .by Quit Claim Deed.
3 . That the Mayor and City Clerk are hereby authorized to ex-
ecute and deliver a Quit Claim Deed to Hill Tower Estates ,Inc .and
4. That the original of said deeds fully executed and ac-
knowledged having been submitted with this Resolution, the same is
hereby approved and confirmed by the Council.
Passed and adopted this 22nd day of September,1980 .
