RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF
CONTEMPORARY URBAN DEVELOPMENT TO REZONE FROM
"R-2" ONE AND TWO FAMILY RESIDENCE DISTRICT
TO "C -P" PLANNED COMMERCIAL DISTRICT
APPROXIMATELY 0.64 ACRES GENERALLY LOCATED
NORTH OF THE NORTHEAST CORNER OF IDAHO STREET
AND MARTIN LUTHER KING JR. DRIVE, AS
FEBRUARY 1, 2010, AT 5:30 P.M. IN THE COUNCIL
CHAMBERS IN CITY HALL AND INSTRUCTING CITY
CLERK TO PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5:30 p.m. on the 1St day of February, 2010,
for the purpose of considering and acting upon an application of
Contemporary Urban Development to rezone from "R-2" One and Two
Family Residence District to "C -P" Planned Commercial District
approximately 0.64 acres generally located north of the northeast
corner of Idaho Street and Martin Luther King Jr. Drive, and
legally described as follows:
P.I.N.: 8912-19-258-001 Deed Description
A survey of that part of the Northeast Quarter (NE 1/) ,
Section 19, Township 89 North (T89N), Range 12 West
(R12W) of the Fifth Principal Meridian (5th P.M.), in
the City of Waterloo, Black Hawk County, State of Iowa,
more particularly described as follows:
Commencing at the Southwest corner of said Northeast
Quarter (NE 1/); thence N89050122"E 16.5 feet along the
South line of said Northeast Quarter (NE 1/), to the
intersection with the North line of Willow Street right
of way, and the East line of Idaho Street, and the
point of beginning; thence continuing N89050122"E
144.20 feet along the South line of said Northeast
Quarter (NE 1/), to the intersection with the South line
of the railway right of way, as recorded in the office
of the Black Hawk County Recorder in Land Deed Book 71
at Page 241; thence N50035122"W 186.64 feet along said
railway right of way to a point on the East line of
Idaho Street right of way; thence S0000010011E 118.90
feet along said East line of Idaho Street to the point
of beginning, containing 8,572.3 square feet, or 0.197
acres, all in the City of Waterloo, Black Hawk County,
Iowa.

A survey of Parcel "E" in the Northeast Quarter (NE 1/),
Section 19, Township 89 North (T89N), Range 12 West
(R12W) of the Fifth Principal Meridian (5th P.M.), in
the City of Waterloo, Black Hawk County, State of Iowa,
more particularly described as follows:
Commencing at the Southwest corner of said Northeast
Quarter (NE %); thence N89050122"E 200.72 feet along
the South line of said Northeast Quarter (NE 1/), to the
intersection with the extension of the South line of
the railway right of way, as recorded in the office of
the Black Hawk County Recorder in Land Deed Book 71 at
Page 241; thence N50035122"W 51.80 feet along said
railway right of way extension to a point on the North

line of Willow Street right of way, and the point of
beginning; thence continuing N50035122"W 186.64 feet
along said railway right of way to a point on the East
line of Idaho Street; thence N0000010011W 77.66 feet
along said East line of Idaho Street to a point on the
North line of the railway right of way; thence
S50035122"E 308.54 feet along said railway right of
way; thence N00000100"W 77.66 feet along said East line
of Idaho Street to a point on the North line of said
Willow Street right of way; thence S8905012211W 94.19
feet along the North line of said Willow Street right
of way to the point of beginning, containing 14,855.4
square feet, or 0.341 acres, all in the City of
Waterloo, Black Hawk County, Iowa.
Remnant Portion of NE %, Section 19, T89N, R12W
A survey of Parcel "D" in the Northeast Quarter (NE 1/),
Section 19, Township 89 North (T89N), Range 12 West
(R12W) of the Fifth Principal Meridian (5th P.M.), in
the City of Waterloo, Black Hawk County, State of Iowa,
more particularly described as a portion of vacated
Willow Street lying East of Idaho Street and West of
the railway right of way, as recorded in the of f ice of
the Black Hawk County Recorder in Land Deed Book 71 at
Page 241, containing 5,414 square feet, or 0.12 acres,
all in the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
