RESOLUTION NO. 2023-245 RESOLUTION APPROVING THE REQUEST OF UNITI DARK FIBER, LLC, FOR THE SALE AND CONVEYANCE OF APPROXIMATELY 0.340 ACRES OF CITY -OWNED PROPERTY, LOCATED NORTH OF 2365 NORTHEAST DRIVE, IN THE AMOUNT OF $40,000.00, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the legal owner of property located north of 2365 Northeast Drive, in the City of Waterloo, Iowa, and legally described as follows: PART OF THE NORTHEAST 1/4 OF SECTION 20, TOWN 89 NORTH, RANGE 12 WEST, LOT 2 OF NORTHEAST INDUSTRIAL PARK PLAT No. 1, CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA DESCRIBED AS: COMMENCING AT THE NORTH 1/4 CORNER OF SAID SECTION; THENCE SOUTH 00°14'36" WEST A DISTANCE OF 50.00 FEET TO THE SOUTH RIGHT OF WAY OF NEWELL STREET (83' WIDE/PUBLIC); THENCE SOUTH 89°47'30" EAST ALONG SAID RIGHT OF WAY A DISTANCE OF 89.45 FEET TO THE NORTHWEST CORNER OF LOT 2 OF SAID PLAT AND THE POINT OF BEGINNING; THENCE SOUTH 00°25'20" EAST ALONG THE WEST LINE OF LOT 2 OF SAID PLAT A DISTANCE OF 227.62 FEET; THENCE NORTH 89°34'40" EAST A DISTANCE OF 64.62 FEET; THENCE NORTH 00°10'05" WEST A DISTANCE OF 226.90 FEET TO SAID RIGHT OF WAY; THENCE NORTH 89°47'30" WEST ALONG SAID RIGHT OF WAY A DISTANCE OF 65.63 FEET TO THE POINT OF BEGINNING. CONTAINING 14,800 SQUARE FEET OR 0.340 ACRES and, WHEREAS, an offer to purchase said parcel of real property, in the amount of $40,000.00, has been made by Uniti Dark Fiber, LLC, and WHEREAS, a public hearing was held on April 17, 2023 at 5:30 p.m., as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey said premises owned by the City of Waterloo, Iowa, to Uniti Dark Fiber, and WHEREAS, it is the opinion of this Council that the sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The above described property located north of 2365 Northeast Drive, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier April 7, 2023, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. 2. That the offer of Uniti Dark Fiber, LLC to purchase said property located north of 2365 Northeast Drive, in the City of Waterloo, Iowa, in the amount of $40,000.00, is hereby accepted for the real property legally described above. 3. That the City of Waterloo, Iowa conveys said parcel of real property to Uniti Dark Resolution 2023-245 Page 2 Fiber, LLC by Warranty deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said Warranty deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to deliver said deed of conveyance to Uniti Dark Fiber LLC upon receipt of the sum of $40,000.00.
