RESOLUTION NO. 2023-247 RESOLUTION APPROVING THE SALE AND CONVEYANCE OF CITY-OWNED PROPERTY LOCATED AT THE SOUTHEAST CORNER OF LEVERSEE ROAD AND HYPER DRIVE, TO 3 STOOGES, LLC, IN THE AMOUNT OF $1.00 AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the legal owner of property located at the southeast corner of Leversee Road and Hyper Drive, in the City of Waterloo, Iowa, and legally described as follows: LOTS 1 AND 2, WATERLOO AIR AND RAIL PARK ADDITI EXCEPT THE SOUTH 145.15 FEET, ALL IN THE CIT F ERLO BLACK HAWK COUNTY, IOWA and, WHEREAS, an offer to purchase said parcel of r , 1 e am nt of$1.00, has been made by 3 Stooges, LLC, and WHEREAS, a public hearing was held on 117, 3 at 5: p.m., as provided by law, by the Council of the City of Waterloo, Iowa, on th opo 0 1 and convey said premises owned by the City of Waterloo, Iowa, to 3 Stooges, d WHEREAS, it is the opinion Council that the sale and conveyance should be made as proposed. NOW, THEREFORE, ICISHEREBY LVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA S F LOWS: 1. The above c ' 0 cated at the southeast corner of Leversee Road and Hyper Drive, in Cit o, Iowa, as fully described in the published notice in the Waterloo Courier April 7, 2023, is t presently needed, and will not be needed in the foreseeable future for municipal purposes, s ownership is serving no municipal purpose. That the offer of Stooges, LLC to purchase said property located at the southeast corner of Leversee Road and Hyper Drive, in the City of Waterloo, Iowa, for the sum of$1.00, is hereby acceptedkthe real property legally described above. 3. T e City of Waterloo, Iowa conveys said parcel of real property to 3 Stooges, LLC by sped warranty deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said special warranty deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to deliver said deed of conveyance to 3 Stooges, LLC upon receipt of the sum of$1.00. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The above described property located at the southeast corner of Leversee Road and Hyper Drive, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier April 7, 2023, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. 2.
