RESOLUTION NO. 2023-280 RESOLUTION AUTHORIZING PROPOSED REPAIRS TO SIDEWALKS IN CONJUNCTION WITH THE FY 2024 SIDEWALK INSPECTION AND REPAIR PROGRAM - ZONE 3. Section 1. That after public hearing on May 1, 2023, notice having been given as required by law, it is deemed necessary and advisable that the sidewalk and/or portions of sidewalks for an area known as Zone 3, be improved by repairing the same. Section 2. That repairs of said improvements will be the responsibility of the owner of said property abutting the sidewalk so designated by the City Engineer as needing repair. Section 3. That all repairs shall be completed by the owner of property abutting said improvement by July 1, 2024 or with evidence of a contract to have the work completed by a bonded contractor per "Notice to Property Owners" attached as "Exhibit A". Section 4. That the City of Waterloo will contract any work not completed by the property owner and an accurate itemized account of all costs and expenses thereof shall be made to this council upon completion of said work. Section 5. That the cost and expense to the City of Waterloo for making said improvement will be assessed, as provided by law, as a special tax against all property abutting sidewalks and/or portions thereof so improved. ATTEST: 7(elley Felchle Kelley Felchle, City Clerk SEAL 0 Ray Feuss, Mayor Pro Tem DIGITALLY SIGNED Resolution No. 2023-280 Page 2 EXHIBIT "A" 2024 SIDEWALK REPAIR PROGRAM -- ZONE 3 NOTICE TO PROPERTY OWNERS April 7, 2023 You are receiving this notice because the City of Waterloo Engineering Department staff have found sidewalk in front of your property that needs to be repaired. The city is divided into twelve (12) sidewalk zones and inspected on a twelve (12) year cycle. This year's inspected area is Zone 3 and is bounded by: West City Limits — Cedar River — West Mullan Avenue — US Hwy 63 — West City Limits. The sidewalk panels that need repair have been marked with one of the following symbols: • White paint circle — single sidewalk panel replacement • White "X" — a sidewalk panel that may need to be replaced because of possible tree roots • White "F" — a sidewalk panel that can be repaired by patching The required sidewalk repairs are also shown on the enclosed Sidewalk Inspection Report with the type of defect(s) explained as well on the back of that report and a sidewalk repair cost estimate prepared by the Engineering Department. This is an estimate of repair cost and not a proposed assessment. You may use this estimate to compare with estimates you may receive from private contractors. Property owners can voluntarily make the repairs that meet current city sidewalk specifications to their sidewalks or hire a contractor to make the repairs. A current Right -of -Way bond is needed to get a permit. You can contact the Waterloo City Engineer's office to determine if a contractor has a current Right-of-way bond. The permit is needed before making the repairs and can be purchased for $40.00 at the City's Engineering Dept. Monday through Friday between the hours of 7:30 to 8:30 a.m. and 12:30 to 1:30 p.m. by the person making the repairs. If repairs are started before a permit is issued you will be issued a notice to stop work and the cost of the permit will be the original $40.00 as well as a penalty of three (3) times the permit cost. If you do not have a current Right -of -Way bond, you will need to get an application form from the City Engineer's Office and have it filled out by your insurance office then returned to the City Engineer's Office and will have to get approved by the City Council at their next regular meeting. Please note the following deadlines: • June 14th, 2023 — Last day to turn in Right -of -Way bond application. • June 23rd, 2023 — Last day to get permit. • July 7th, 2023 - Last day to complete repairs. If sidewalk repairs are not completed by the deadline, the repairs will be made through the City's Sidewalk Repair Assessment Program and sidewalk marking will be remarked in green and a notice stating that you are in the assessment program will be sent out. The total cost for repairs will be sent to the property owner who will have 30-days to make payment to the City. Any balance remaining after the deadline on the invoice will be certified and submitted to Black Hawk County to be included as a special assessment on the property taxes. The total cost shall include, but are not limited to, engineering, inspection, construction and administrative costs. Resolution No. 2023-280 Page 3 PUBLIC HEARING DATE The Waterloo City Council will hold a Public Hearing regarding the necessity of sidewalk repairs at their regular council meeting on Monday, May 1st, 2023 at 5:30 p.m., in the Council Chambers in the Waterloo City Hall. At this hearing, property owners or any other person may appear and speak either for or against the need of the repairs. A property owner will have waived all objections, unless they appear at the hearing or they have filed written objections with the Clerk by the time of the hearing. This Notice is given by authority of the Council of the City of Waterloo, Iowa.
