A RESOLUTION FIXING THE TIME AND PLACE OF HEARING
AND NOTICE TO BE GIVEN ON VACATION OF CERTAIN EASE-
MENT IN NE FRACTIONAL 4 OF SECTION 2-88N-13W NEAR
CORNER OF HIGHWAY 412 AND LAPORTE ROAD AREA AS SEPT-
EMBER 24, 1979, AT 7:00 P.M. IN COUNCIL CHAMBERS OF
CITY HALL AND INSTRUCTING THE CITY CLERK TO PUBLISH
THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, 'OVA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of Water-
loo, Iowa at 7:00 o' clock P.M. , on the 24th day of September, 1979,
for the purpose of considering and acting upon a proposal to vacate
a portion of a drainage easement in NE Fractional 4 of Section 2-
88N-13W near corner of Highway 412 and LaPorte Road area, requested
by George Lindeman, Atty. , for M & K Enterprises, owned by the City
of Waterloo, Iowa, described as follows:
A parcel of land located in the Northeast Fractional 4
of Section 2, Township 88 North, Range 13 West of the
5th Principal Meridian, Black Hawk County, Iowa des-
cribed as follows:
Commencing at the NW corner of said NE fractional
4 Section 2; thence North 90° East a distance of
1023.7 feet ; thence South 0° 05 ' West a distance
of 458. 6 feet ; thence South 23° 24 ' 30" East a
distance of 285.8 feet ; thence South 41° 24 '
East a distance of 124. 34 feet ; thence South
63° 48 ' West a distance of 24.87 feet to the
point of beginning; thence South 63° 48 ' West
a distance of 16. 17 feet ; thence North 48° 36 '
East a distance of 15.6 feet ; thence South 41°
24 ' East a distance of 4. 24 feet more or less
to the point of beginning. (Contains 33 sq.ft .)
Section 2. That the City Clerk is hereby directed to publish notice
of the time and place of said hearing in the Waterloo Daily Courier,
in the manner provided by Section 362. 3 of the 1975 Code of Iowa.
Passed and adopted this 4th day of September, 1979.
