RESOLUTION AUTHORIZING THE CONVEYANCE OF A PORTION OF ALLEY IN
BLOCK 12, CONGER PARK, TO LORRAINE HURLBUT, WIDOW OF A.R. HURLBUT,
IN EXCHANGE FOR OTHER REAL ESTATE CONVEYED TO THE CITY BY A.R.
HURLBUT BY DEED DATED AUGUST 20, 1952, AND DIRECTING AND AUTHOR-
IZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR
SAID PROPERTY.
WHEREAS, the City of Waterloo, Iowa, is the owner of real property, in the City of Waterloo,
Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real property in exchange for other
real estate conveyed to the City of Waterloo, Iowa, by A.R. Hurlbut by deed dated August 20, 1932,
and costs, was made by A.R. Hurlbut and Lorraine Hurlbut, Waterloo, Iowa, and
WHEREAS, the Notice of Public Hearing published in the Waterloo Daily Courier on September 3
and 10, 1952, contained an incorrect legal description and failed to state the City of Waterloo
proposed to sell the below described vacated real property to A.R. Hurlbut and Lorraine Hurlbut,
and to clarify the original sale action taken in September, 1952, and
WHEREAS, a public hearing was held on September 10, 1979 at 7:00 P.M. in the Council Chambers
in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa
on the proposal to convey premises owned by the City of Waterloo, Iowa, to Lorraine Hurlbut,
widow of A.R. Hurlbut, Waterloo, Iowa, and
WHEREAS, it is the opinion of this Council that conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully described in the published notice in the
Waterloo Courier, on August 31, 1979, is not presently needed and will not be needed in the fore-
seeable future for municipal purposes and its ownership is serving no municipal purpose:
That portion of the alley in Block 12, Conger
Park in the City of Waterloo, Iowa, described
as follows: Commencing at a point in the South
line of Lot 16 in John G. Miller Subdivision of
Lots 8, 9, 10, 11 and 12, in Block 12 in conger
Park, an Addition to Waterloo, Black Hawk County,
Iowa, that is 3.17 feet West of the Easterly
corner of said Lot 16; thence East along the
South line of said John G. Miller Subdivision
of Lots 8, 9, 10, 11 and 12, in Block 12 in
Conger Park, an Addition to Waterloo, Black
Hawk County, Iowa, to the Southeast corner of
Lot 7A in said Subdivision; thence South 1 foot;
thence West along a line 1 foot from and parallel
with the South line of said Subdivision to a
point 1 foot South of the point of beginning;
thence North to the point of beginning.
2. That the offer of Lorraine Hurlbut, widow of A.R. Hurlbut to
purchase said realin exchange for other real estate conveyed to the City of Waterloo, Iowa, byA.R. Hurlbutrbyerty deed
dated August 20, 1952, and costs be, and it is hereby accepted.
3. That the City of Waterloo, Iowa, convey said parcel of real property to Lorraine Hurlbut,
widow of A.R. Hurlbut, by Quit Claim Deed, the form of which is hereto attached and approved.
4. That the Mayor and City Clerk are hereby authorized to execute and deliver said deed to
Lorraine Hurlbut, widow of A.R. Hurlbut.
5. That the original of said deed, fully executed and acknowledged, having been submitted
with this Resolution, the same is hereby approved and confirmed by the Council.
6. That the City Clerk is authorized and directed to deliver said deed of conveyance to
Lorraine Hurlbut, widow of A.R. Hurlbut.
Passed and adopted this 10th day of September, 1979.
