RESOLUTION BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
AS THE WATERLOO HOUSING AUTHORITY, ENTERING INTO A "MEMORANDUM
OF AGREEMENT" WITH THE WATERLOO NEIGHBORHOOD HOUSING SERVICES,
INC. REGARDING A SPECIAL ALLOCATION FROM THE U.S. DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT OF FIFTY (50) SECTION 8
EXISTING HOSUING UNITS TO BE KNOWN AS PROJECT IA05-E050-005,
AND AUTHORIZATION FOR THE WATERLOO HOUSING AUTHORITY'S AGENT,
THE WATERLOO CHAMBER OF COMMERCE, TO MAKE APPLICATION FOR SAID
PROJECT.
WHEREAS, Waterloo Neighborhood Housing Services, Inc. (NHS) has been
granted a special allocation of fifty (50) units of Section 8 Existing
Housing; and
WHEREAS, the Waterloo Housing Authority, pursuant to its 1979 Housing
Assistance Plan, recognizes the need for the additional allocation of fifty
(50) units for the City of Waterloo, Iowa; and,
WHEREAS, the Waterloo Housing Authority, as the Public Housing Agency
for the City of Waterloo, Iowa, must make formal application to the U. S.
Department of Housing and Urban Development for said allocation,
NOW THEREFORE BE IT RESOLVED that the Waterloo Housing Authority hereby
enters into the attached "Memorandum of Agreement" with Waterloo Neighborhood
Housing Services, Inc.
BE IT FURTHER RESOLVED that the Waterloo Housing Authority directs its
Managing Agent, the Waterloo Chamber of Commerce to make formal application to
the U. S. Department of Housing and Urban Development for fifty (50) units of
Section 8 Existing Housing as described in the "Memorandum of Agreement," and
that this Resolution was passed and adopted after a Public Hearing was held on
the matter.
Passed and adopted this 24th day of September, 1979, approved by the

MEMORANDUM OF AGREEMENT
This Memorandum of Agreement, entered into this 17th day of September, 1979,
by and between Waterloo Neighborhood Housing Services, Inc. , hereinafter referred
to as "NHS", and the City of Waterloo, Iowa as the Waterloo Housing Authority,
hereinafter referred to as "PHA", provides as follows:
WHEREAS, NHS is a locally-controlled, non-profit corporation which has been
established with the assistance of the Neighborhood Reinvestment Corporation and
which aids owners of properties in the NHS designated area of the City of
Waterloo, Iowa (See Addendum A for description of NHS designated area) to improve
their homes and apartments and bring them up at least to minimum housing code
standards by providing counseling, assistance in dealing with contractors,
referrals to private financial institutions; and, in cases where owners are
unable to meet commercial credit standards, by providing direct loans at flexible
rates and terms; and,
WHEREAS, the Neighborhood Reinvestment Corporation has obtained an informal
committment from the U. S. Department of Housing and Urban Development to allocate
fifty (50) units of Section 8 Existing Housing to the PHA to provide rental
assistance for families adversely affected by private rehabilitation, including
but not limited to families in the NHS designated area of the City of Waterloo,
Iowa,
NOW THEREFORE, the parties herewith agree as follows:
1. Upon approval by the U. S. Department of Housing and Urban Development
of a special allocation of Section 8 Existing Housing units for families adversely
affected or to be adversely affected by private rehabilitation, NHS shall perform
the following functions:
a. Disseminate information concerning the availability of Section 8
Housing Assistance Payments for low and very low-income families,
primarily through personal contact and counseling;
b. Provide information to families and property owners regarding
housing standards, inspection proceedures, and basic program rules;
c. Take preliminary applications from families and refer families to
the PHA's Managing Agent, the Waterloo Chamber of Commerce, for
for determination of eligibility and/or gross family contribution;
d. Conduct inspections for the purpose of certifying a dwelling unit as
being eligible for initial or continued participation in the Section
8 Existing Housing Assistance Payments program, such inspections to
be conducted in accordance with 24 Code of Federal Regulations
882.109. by NHS Inspection Staff;
e. Provide families with necessary relocation advice;
f. Provide the PHA's Managing Agent, the Waterloo Chamber of Commerce,
with specific quarterly estimates of the number of applicants and
and landlords to be afforded preference for participation in this
NHS sponsored Section 8 Existing Housing program;

2. The PHA and its Managing Agent, the Waterloo Chamber of Commerce, shall
perform all functions required under Section 8 of the U. S. Housing Act of 1937,
as amended, the Annual Contributions Contract (ACC), Section 8 Existing Housing
program rules set forth at 24 Code of Federal Regulations 882, and all applicable
handbooks and guidelines as are or may be established by the U. S. Department of
Housing and Urban Development. The PHA's Managing Agent shall further provide
the following to NHS:
a. Notification when a family referred to the PHA is issued a
Certificate of Family Participation;
b. Notification when a family is determined to be ineligible to
participate in the Section 8 Existing Housing program
c. Notification when a Housing Assistance Payments Contract is
executed on behalf of an eligible family with a landlord.
3. Under this NHS sponsored allocation of Section 8 Existing Housing, the
PHA and its Managing Agent, the Waterloo Chamber of Commerce, shall grant
preference to the following:
a. Participation of landlords whose property is located within the
NHS designated area;
b. Participation of families who, because of higher rents resulting
from property rehabilitation, would have to pay..more than 25% of
their income for rent or be forced to move.
4. The PHA may issue Certificates of Family Participation to any family
in the event that NHS fails to refer on a quarterly basis sufficient numbers of
eligible families to meet the twelve (12) month leasing schedule required under
Section 8 Existing Housing programs.
5. The PHA may accept participation of landlords whose units are not
within the NHS designated area if sufficient units from within the NHS designated
area cannot be committed to the Section 8 Existing Housing program.
6. This Memorandum of Agreement shall not be construed to limit the number
of Certificates of Family Participation to residents or the number of dwelling
units from the NHS designated area.
7. The term of this Memorandum of Agreement shall be five (5) years commencing
with the effective date of the Annual Contributions Contract (ACC) covering the
NHS sponsored Section 8 Existing Housing allocation.
8. This Memorandum of Agreement shall be subject to approval by the U. S.
Department of Housing and Urban Development.

ADDENDUM "A"
DESCRIPTION OF NHS DESIGNATED AREA
OF THE CITY OF WATERLOO, IOWA
The NHS Designated Area of the City of Waterloo, Iowa is that area enclosed
by a line beginning at the intersection of Linden Avenue and Franklin Street,
proceeding therefrom Westerly along Franklin Street to its intersection with Lane
Street, proceeding Northerly therefrom along Lane Street to its intersection with
the Illinois Central Gulf Railroad tracks, proceeding therefrom East-Northeasterly
and then Northwesterly along the Illinois Central Gulf Railroad tracks to its
intersection with Logan Avenue, proceeding therefrom Northerly along Logan Avenue
to its intersection with the Waterloo Railroad tracks, proceeding therefrom
Southeasterly to its intersection with Linden Avenue, proceeding therefrom
Southerly along Linden Avenue back to the point of beginning, its intersection
with Franklin Street.
All said streets, avenues and railroad tracks being located within the
City of Waterloo, Iowa.
