RESOLUTION DEDICATING A 1,765 SQUARE FOOT
STORM SEWER EASEMENT AT 2320 WEST 9th STREET
GENERALLY LOCATED AT THE NORTHWEST CORNER OF
EASTON AVENUE AND WEST 9th STREET IN THE CITY
OF WATERLOO, BLACK HAWK COUNTY, IOWA.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, that the following described property:
Storm Sewer Easement Legal Description:
An easement for the construction, operation and
maintenance of a storm sewer over that part of Lot 13,
Block 3 of Liberty Addition, in the City of Waterloo,
Black Hawk County, Iowa, more particularly described as
follows:
Beginning at the southwest corner of Lot 13; thence N
89°31'11" W 157.00 feet along the south line of said
Lot 13; thence N 81°24'41" W 159.41 feet to a point on
the west line of said Lot 13 that is 22.50 feet from
the southwest corner of Lot 13; thence S 01°36'39" E
22.50 feet along said west line of Lot 13 to the Point
of Beginning, all in the City of Waterloo, Black Hawk
County, Iowa;
be and the same is hereby dedicated for storm sewer easement
purposes.
PASSED AND ADOPTED this 19th day of July, 2010.

AFFIDAVIT
1, William W. Castle, a Professional Land Surveyor and Civil Engineer, License #19715, being first
duly sworn on oath, depose and state as follows:
I prepared a Plat of Survey and legal description for a Storm Sewer Easement over a portion of
Lot 13, Block 3, in Liberty Addition. Said Plat of Survey was signed July 9, 2010 and filed for record on
March 2, 2011, in the records of the Black Hawk County Recorder as File 2011-00017146.
This Affidavit is being made and recorded to address an error in the Storm Sewer Easement
Legal Description on the Plat of Survey attached as Exhibit "A".
Where it states: thence N 89°31'11" W 157.00 feet along the south line of said Lot 13;
It should state: thence S 89°31'11" E 157.00 feet along the south line of said lot 13;
In all other respects, the original, recorded document shall not change.
AFFIANT FURTHER SAYETH NOT.
